Judge to decide if Lindsay Lohan gets break or jail

The latest Lindsay Lohan drama unfolds in a Beverly Hills, California, courtroom Thursday morning without its leading lady.

Lohan will miss a mandatory court hearing because the actress-singer lost her passport while on a trip to the Cannes Film Festival in France this week, her lawyer said.

Los Angeles Superior Court Judge Marsha Revel must decide if Lohan's absence warrants sending the actress to jail, something she threatened last October if Lohan failed again to the probation requirements from a 2007 drunk driving conviction.

Judge Revel could issue a bench warrant for Lohan's arrest or she could allow Lohan to participate over the phone from Paris, where she is waiting for a new passport from the U.S. Embassy.

"It remains to be seen," Lohan attorney Shawn Chapman Holley said Wednesday.

The judge told Lohan last fall that although she wanted her to have her career, the actress could not "thumb your nose" at the court.

Lohan traveled to France this week to promote her newest movie role as the 1970s porn star Linda Lovelace. She missed her return flight from Paris Tuesday because she lost her U.S. passport, Holley said.

"I don't know if it was stolen or lost, misplaced," Holley said. "It's gone."

The purpose for Thursday's hearing is to determine if Lohan has been attending weekly alcohol counseling sessions ordered by Revel.

Holley said Lohan is in "substantial compliance" and that the counseling program director would be in court to tell the judge.

"Is it absolutely perfect in terms of her attendance? No, but it's actually better than most people in these classes," she said.

Though the judge said Lohan must attend one class a week, she did say she could ask for court permission to adjust the schedule for her work. Any travel beyond 21 days that would cause her to miss meetings must be approved by the court, Revels said.

Lohan was arrested twice in 2007 on charges of driving under the influence and in the second incident also was charged with cocaine possession.

The first arrest - in May - came after Lohan lost control of her Mercedes-Benz convertible and struck a curb in Beverly Hills.

Just two weeks after checking out of a Malibu drug and alcohol rehab facility, she was arrested again in July 2007 after a woman called Santa Monica police, saying Lohan was trying to run her down with a car.

Lohan was sentenced to three years of probation after she entered guilty and no-contest pleas to the charges.

Lohan's acting career, which started at age 10 on a soap opera, took off on the big screen a year later when she played identical twins in Disney's "The Parent Trap."

    her mother,dina is just about the worst mother in history,she just refuses to believe her daughter is really screwed up!
    bet she regrets that at lindsay's funeral!

    All I have to say is this: If I got a DUI my parents would have beaten my @ss. If I had gotten a second I would catch an @ss beating and some jail time (by request of parents no doubt).

    I got caught stealing when I was 15, I got punished by getting 24 hours community service. The place was 8 miles away and I had to be there at 6 am......I walked. My parents had me walk to and from every day taking hours out of my day. I surely never stole again.

    If parents have a little more tough love with their kids they learn much faster. Nature has tough love, you stick your hand in fire you get burned. Then you never do it again. Most of this crap is a 1 time lesson is there is a severe punishment. Enough said

    This should be handled the way it would be handled for any average citizen. If I was warned repeatedly and still missed my court hearing, I would expect the punishment. Just because it's Lindsey and Cannes doesn't make the excuse any more legit. She could have lost her passport on purpose for that matter. It will be interesting to see what happens.

    She needs to be forgotten about,..because if not,..
    than,..by next year, at this time We may just be posting about her "untimely" death,..
    I don't think she is in a place where she can get out of this,.by herself,..
    and the whole world is watching this downward spiral,..
    If you think about this,..truly,..It is very very sad.

    Yep... 3 years ago the story was "She'll be dead my next year." 2 years ago, the story was "If she keeps this up, she'll be dead by next year." Last year, I believe the story read "If Lindsay keeps this up, she will be dead by next year."

    Let's keep it going. She'll be dead by next year guys! I just hope she outlives some of you fat people, bumbling through your post with greasy fingers from the McDonalds you inhaled. Live in your trailers, pop out some more kids, and voice your opinion about Lohan on CNN! What a life you live.

    I have lost my passport and they issued my passport in one hour in Spain....It should not take more than a day or max three for passport issuance.....she needs jail time.
