Judge to decide if Lindsay Lohan gets break or jail

The latest Lindsay Lohan drama unfolds in a Beverly Hills, California, courtroom Thursday morning without its leading lady.

Lohan will miss a mandatory court hearing because the actress-singer lost her passport while on a trip to the Cannes Film Festival in France this week, her lawyer said.

Los Angeles Superior Court Judge Marsha Revel must decide if Lohan's absence warrants sending the actress to jail, something she threatened last October if Lohan failed again to the probation requirements from a 2007 drunk driving conviction.

Judge Revel could issue a bench warrant for Lohan's arrest or she could allow Lohan to participate over the phone from Paris, where she is waiting for a new passport from the U.S. Embassy.

"It remains to be seen," Lohan attorney Shawn Chapman Holley said Wednesday.

The judge told Lohan last fall that although she wanted her to have her career, the actress could not "thumb your nose" at the court.

Lohan traveled to France this week to promote her newest movie role as the 1970s porn star Linda Lovelace. She missed her return flight from Paris Tuesday because she lost her U.S. passport, Holley said.

"I don't know if it was stolen or lost, misplaced," Holley said. "It's gone."

The purpose for Thursday's hearing is to determine if Lohan has been attending weekly alcohol counseling sessions ordered by Revel.

Holley said Lohan is in "substantial compliance" and that the counseling program director would be in court to tell the judge.

"Is it absolutely perfect in terms of her attendance? No, but it's actually better than most people in these classes," she said.

Though the judge said Lohan must attend one class a week, she did say she could ask for court permission to adjust the schedule for her work. Any travel beyond 21 days that would cause her to miss meetings must be approved by the court, Revels said.

Lohan was arrested twice in 2007 on charges of driving under the influence and in the second incident also was charged with cocaine possession.

The first arrest - in May - came after Lohan lost control of her Mercedes-Benz convertible and struck a curb in Beverly Hills.

Just two weeks after checking out of a Malibu drug and alcohol rehab facility, she was arrested again in July 2007 after a woman called Santa Monica police, saying Lohan was trying to run her down with a car.

Lohan was sentenced to three years of probation after she entered guilty and no-contest pleas to the charges.

Lohan's acting career, which started at age 10 on a soap opera, took off on the big screen a year later when she played identical twins in Disney's "The Parent Trap."

    No, not all people are like Lindsay Lohan. What kind of ignorant, short-sighted statement is that to make? For one, most people can't afford to be so reckless at her age. You can't be hung over and still work a job. Most kids her age do not have her income and have to get up and get on a train or in a car and get to a place that gives them a check. And for every party girl or guy, there is a responsible, hard-working, humble young person who hasn't been handed everything and wants to make something of their life. You don't have to be in denial to believe your kid is not out getting drunk every night because not all of them do.

    And, yah, I scammed my own parents, too, but have yet to get a DUI or appear before a judge or get so drunk I woke up the next day and couldn't find my ID. My sister drunk drives and scams everyone. We are all different, folks.

    Laws are to protect us. Anyone who breaks the law is a threat to everyone. Everyone should be treated equally when we break the law. We need to pay the price so that we will learn from our mistakes. My children are still quite young, but I hope I would have the strength to leave them in jail overnight rather than bailing them out if ever they are arrested. It would be difficult, but I'm sure they would think twice before doing something dumb again.

    She had an ankle bracelet – that didn't work for her either. Jail time will be 20 min – like others have said.

    She needs 3-6 months bootcamp. That is what my son ended up with - did him a world of good

    I teach many young adults in this age range, and I can say that she is not like most, let me assure you. This child (I will call her that) is on a path headed for not a nice place, IMO. There are some, and for those in the minority (probably the ones here whom are supportive of these at times immature and dangerous behaviours), yes, you are probably relate to her very well – people like others who hold the same or similar beliefs.
    But please do not espouse this as mainstream or majority 20 year olds' behaviour. For the ones whom are shouting down the parents, IMO it is you who needs a wakeup call. If you do not want to grow up, that's one thing, but don't profess it to be mainstream behaviour.

    Well I am a 14 year old and I think that Lohan needs to get a reality check. We all know she's famous but still you just can't go out there and ruin your parents rep like that Like my mother say once you step out that door you repesent me so be good and act like a young lady and I try to follow that but still some older people need to have fun but just dont go wild with it.

    i called this years ago. when she partied her money away, now she has next to nothing left; her mother lives to be seen in the papers and on the news. she is not a proper parent for a messed up child. she can't make movies because no one will insure her. yes, that's true now, too. the girl is a waste of time and should be in jail for a very long time. lost her passport? what a joke! she's just avoiding a court date. her father is probably the best thing for her. otherwise, don't waste my time w/stories about what event she shows up for, what she's doing, and what her mother does. i don't care about her. she's bad news.

    She lost her passport? How convenient...I hope the Judge sentences her to jail. She needs a wake up call. Hollywood should not be hiring her for any jobs. She's ugly and not a good actress anyway...so many better actors to do the job. She just a spoiled loser.

    Didn't realize how many "losers" were on this board. If Lohan is like YOU or your friends, you are losers too. Please don't try to tell me how my kids(25 and 29 ) are. You are just trying to excuse your loser mentality. In 10 years you will all be working( if you are lucky) for someone your own age or younger who does see the problem with being an irresponsible drug/booze addict. Grow up.

    All these people that blog on this story all have this great sense of outrage over Lohan missing her court date because she lost her passport. Get a life people. First she was put on probation for three years.back in June 2007. That means she has met all the guidelines for her probation for 2 years and 11months. Does it make any sense that she would act like a spoiled brat now when she has only a month to go? Lohan didnt flagrantly ignore the fact she had to go to court, she just lost her passport and is asking for a LITTLTE amount of time to fix the problem . Shes trying to resurrect her career, why would she risk being branded a high risk commodity by the motion movie picture industry and flagrantly break the law again? Any judge would grant leniency to anyone who met the guide lines of their probation for so long so theres no need to bribe the judge. Pres Dubya had a history of DUI and cocaine possesion yet you morons voted for him twice! Where was your sense of outrage when THAT spoiled brat after just being told of the 911 attacks just sat in a chair and listened to a 6 year old read him a story about a goat! Dubya was a let down to this country and the world. The only person ever let down was herself

    The debate of whether all kids do or don't do the same things to have fun will never end; however, as long as young celebrities are glamourized by the destructiveness in which they live, regular kids will always copy.
    When the media stops publishing and glamorizing sensationalist trash, when law enforcers stop being pressured by the so called celebrity status of these kids and most importantly when parents begin to teach their children the meaning of accountability and begin to take responsibility for their actions, then we'll see our regular kids change. Unfortunately it is monkey see monkey do with the only difference being that regular kids get punished to the full extent of the law. Has anyone heard of a double standard?.....

    As a celebrity she is, and should be, treated with more respect and given the benefit of the doubt more than the hillbilly nobodys on this forum whining that she should be in jail. She's far more important to society than all of you combined, and shouldn't be harrassed by the law unless it's a really serious offense. Nothing she's done should ever have even been prosecuted in the case of somebody of her stature. I say put the publicity hungry DA in jail for harrassment.

    To the people who say she is doing normal "twenty year old things".... where are you from?? I am a 24 year old female and have never had a DUI or arrested for possesion of cocaine. Most people my age are either working or going to school. Although partying recreationally is common, I believe she's far worse off than the average twenty year old. She'll be the next hollywood death tragedy if she doesn't get help soon, I gaurantee it.

    The problem with that David is, she is driving around Coked up and kidnapping people so she could endanger someone's family or friend,maybe not yours David but she is a danger to people minding their own business on the roads.
