Court rules for gun rights, strikes Chicago handgun ban

In another dramatic victory for firearm owners, the Supreme Court has ruled unconstitutional Chicago, Illinois' 28-year-old strict ban on handgun ownership, a potentially far-reaching case over the ability of state and local governments to enforce limits on weapons.

A 5-4 conservative majority of justices on Monday reiterated its two-year-old conclusion the Constitution gives individuals equal or greater power than states on the issue of possession of certain firearms for self-protection.

"It cannot be doubted that the right to bear arms was regarded as a substantive guarantee, not a prohibition that could be ignored so long as states legislated in an evenhanded manner," wrote Justice Samuel Alito.

The court grounded that right in the due process section of the 14th Amendment. The justices, however, said local jurisdictions still retain the flexibility to preserve some "reasonable" gun-control measures currently in place nationwide.

In dissent, Justice Stephen Breyer predicated far-reaching implications. "Incorporating the right," he wrote, "may change the law in many of the 50 states. Read in the majority's favor, the historical evidence" for the decision "is at most ambiguous."

He was supported by Justices John Paul Stevens, Ruth Bader Ginsburg and Sonia Sotomayor.

      Why do conservatives believe in "states rights" and don't want the Federal Government interferring with local issues, then they applaud this ruling? I guess when it comes to guns they don't want to be conservative, just stupid. There are other ways to defend your home then with a hand gun.

      If guns are so responsible for killing people (vs. people using guns improperly) – then in the same vain we will have to ban all vehicles (because they kill even more people than guns), matches (because they start fires that kill people), and the list goes on.

      Guns are not the problem – PEOPLE are,

      And if you argue guns are the problem – you'll have to give up your car because cars kill more people than guns!

First, would you care to explain why Virginia's violent crime rate dropped to its lowest in 30+ years immediately after they passed a sweeping drawdown of their handgun restrictions allowing such things as open carry? And second, if handguns are made to do nothing other than kill people, are you then of the opinion that police carry handguns just so they can kill people?

      Adam – Chicago, you are incorrect, the chicago gun ban stopped the registration of firearms in the city of chicago, and due to the fact that it is legally required for you to register your firearm in the city of chicago, it effectively banned guns in chicago entirely.

      considering how gun-related murders skyrocketed after the gun ban was put in place and is still higher to this day, i'm guessing the ban didn't work out as well as planned...

I would love to see the demographics of people from Chicago who actually defend themselves with handguns from criminals. Get real this is a special interest backroom conservative deal..       What this means is that more honest people will be able to obtain a gun? probably. will they ever use it to defend their homes? doubtful. Is it much more likely to be the cause of the death for their child who finds it and kills themselves in an accident? Definitely. So enjoy your victory, but if you get a gun keep it locked up and away so that it doesn't kill an innocent person.

      I live in Chicago, This is not a good thing for Chicago. The news can tell you one thing but i know otherwise. Hand gun crimes are actually down from the 80's and 90's. And if people was to only keep their handguns in their homes, then maybe. However, what will happen is more people teenagers and young adult children will get a hold of these weapons for the wrong use. Citizens will be carrying while out of their homes.

      When will all of the ANTI-Gun activists realize that Perpetrators/Murderers/Terrorists will always be able to obtain a firearm by illegal means. Taking away the right for law abiding citizens to own a firearm only helps the criminals and hinder the law abiding citizen. Gun crimes are committed by criminals and 95% of the time the gun is illegally possessed. The bad guy will always get a gun so why hurt the good guy from protecting himself or his family by owning a gun legally. Ol because alcohol can't kill it is the idiot drinking it then driven.and anyone over 21 can buy booze and get a dl to drive drunk. ban booze and save 25 times more then guns. The big issue is not let'ing people that have been under dr. care get one.No state or feds require you to inform them of mental break downs or help for it.

      Yes, we have a right to bear arms, but do we really need them to feel safe. I live right off the iron triangle, it is the most dangerous place in the Bay Area. I don't have a gun, and would not use one if the need arises. Owning a gun would not make me feel any safer. Yes, we should be able to protect ourselves, but guns are not a be all end all that some gun owners want us to believe. There needs to be better legislation for gun ownership, so that those weapons don't end up in the hands of criminals and children. Law is based on interpretation of a rule. If all of the justices agreed, then it would be understandable that they came to the same conclusion, but they did not it was a 5 to 4 decision, which leaves me to believe it has major flaws.

      I am in favor of protecting home and land; however it DOES NOT allow thugs gangs and drug dealers to possess them illegally as well as the average joe to just go buy a gun and go the heck off.
      owning firearms is a responsibility as well as a right. I helped to keep this right. how ever I do support the confiscation of illegal possession

Gun are bought cheaply and legally in bulk in places like Georgia, Texas, Alabama and Florida, then driven up the I-95 corridor and sold at illegally at inflated prices to known criminals in DC, Baltimore, Philly, NYC, Boston. OR they're driven across the border and sold to Mexican drug cartels. You know, the same ones you conservatives are trying to protect Arizona from with racist immigration laws. How about rather than alienating every Latino in the nation to protect yourselves, perhaps you would consider not selling the cartels guns anymore. You want safer neighborhoods?       You clearly have not done any research on the subject. This is pure speculation and simply an ignorant statement. Honest gun owners do not give or sell to criminals (that would make them criminals as well) and the number of stolen guns from "honest" gun owners is a very minute percentage toward illegal guns.

      Lisa from Florida...This ruling has to do with handguns specifically, not assault weapons. Funny you should mention assault weapons, because the assault weapons ban expired near the end of GW's last term in office, and oddly enough Obama has not reinstated it. I actually support the assault weapons ban in general (although it needs some bugs worked out of it)...I own oh let's just say well over 40 fire arms, am an avid hunter and collector...2 of the weapons qualify as "assault weapons" but really aren't.

      This is not a valid argument. If possession of a handgun is illegal, then by definition possession of a handgun makes you a criminal. In addition, citizens who do not possess handguns do not commit gun crimes. Try again.

      Ironic that the first thing that most liberals do after they have been the victim of a violent crime and were unable to defend themselves – is go out and buy a gun and learn to shoot. You really don't understand the purpose of a gun until you are unable to defend yourself or your family -then you experience a perspective shift. All the idealism kind of fades away, the fog clears and you understand what the real world is like. There are bad people in it. They don't obey any stupid law you pass. They take what they want from the weak and then the cops come and arrest them – 10% of the time and then the lawyers and judges let them go 50% of the time to go and do it again. But it is a stupid debate anyway. There are 100 million gun owning Americans. Those are just the ones that admit to owning guns. Good luck trying to disarm 100 million people.

      Downtownbrown, You are incorrect. According to the FBI uniform crime report, which is issued every year, violent crime is DECLINING. That includes murders. On the other hand, according to the Federal Transportation Administration, the number of people killed by drunk drivers is INCREASING and has surpassed the number of people killed with a gun.

I have yet to draw my firearm on anybody and i highly doubt i will ever have to but you know what? i want to be prepared for when im faced in situation where i might have to protect myself and my family. Fact is criminals will always have weapons no matter what you do....you know why? because a criminal doesn't give a damn about whats written on a piece of paper that's says oh no you cant do that that's illegal. Check in with reality more laws are needed for punishment of illegally obtained firearms and crimes themselves.

      ok storytime kids...i live where i hear gun shots every night past midnight. i dont figure these are registered guns, i dont choose where i live i kinda have to due to pay. so when when a illegal gun comes to my house i cant protect my family? your ignorant, come live a night where im at you'll change ur mind. if i cant have guns in my house i would be dead along with my girls and boy. it is easy to get illegal guns so y make it hard for the honest ppl to get a legal one. oh n by the way all guns kill things not just hand guns. And juss like the law supply and demand, theres always guns, drugs, and other illegal activities it just a fact that if u want u can get legal or illegal.       Then go back and live in the state of nature that existed before we had societies and take your gun-toting friends with you. Obviously, we have to amend the Consitution to clarify that the Founders were talking about militias, which the conservative membersof the Court seemed to have missed (even though it is written right there in the Amendment in plain English–which means that Framers were not so studpid and did not mean the states and local govcernments cannot keep public peace by regulating guns.
