U.S. cites risk to security in seeking lawsuit dismissal

Anwar al-Awlaki has been linked to al Qaeda in Yemen by U.S. officials.

The Obama administration has invoked the state secret privilege in seeking to dismiss a lawsuit filed on behalf of the father of Yemeni-American cleric and militant Anwar al-Awlaki, which sought to prevent the U.S. government from trying to target him for assassination.

The government contended in a court filing that was submitted early Saturday morning that the case "would require the disclosure of highly sensitive national security information concerning alleged military and intelligence actions overseas."

"The plaintiff has demanded the government disclose a wide variety of classified information that could harm our national security. It strains credulity to argue that our laws require the government to disclose to an active, operational terrorist any information about how, when and where we fight terrorism, Matthew Miller, Justice Department spokesman, said in a statement Saturday.

The court filing said the injunction sought by the al-Awlaki's father "would be unprecedented, improper and extraordinarily dangerous." It would "improperly inject the courts" into the administration's decisions on "how to protect the American people from the threat of armed attacks."

Miller notes the lawsuit - which never denies Anwar al-Awlaki's militant activity - said if al-Awlaki "wishes to access our legal system," he should surrender and then "be held accountable for his actions."

      If you read the quotes from the ACLU and that other org., you will see that they hinted at the proper way to go -

      –essentially saying, "hey, just give him the minimal "due process" under our laws and there shouldn't be any problem."

      Nobody said the "due process" has to be open to the public. A proper military court should be able to wrap this up in very little time if they know what's what.
      Keep yer dam secrets while providing a few safeguards that touch on the due process that is, at minimum, required in any case involving a U.S. Citizen.
      How hard is that??????? Good God, you'd think it was rocket science or brain surgery when it's more like taking out the trash....

    We can't have trials concerning anything about 9/11. Just ask any of the 911 victims families how their lawsuits are going. "for reasons of national security" my azz. More like "for reasons if the truth comes out in a court of law, this and the previous administrations leaders will be found out and dealt with". Follow the victims of 9/11 families lawsuits if you want the truth. If not, follow tv.

    It is past time for the ACLU. They are no longer or in my opinion ever been a crediable source of information. They are the short arm of terriorism and should be disbanded NOW. Just like ACORN and their voter fraud.

      The ACLU might be the only thing standing between you and having your rights taken away.
      Don't compare them to ACORN or any of those dumb Texan organizations, they are as ethical an American organization as you'll ever find. They are committed to saving your sorry a** even if you are too stupid to know how or why.

      In this case, they are merely asking that "due process" be observed. That shouldn't be too hard for Americans in our Armed Forces unless they are as thick as you. They can do a semi-secret military court or something that would satisfy the ACLU, but they are a little busy right now to think of these things.

      I want that sleazeball taken out, but if we missed second base or something, we'd better cover that right quick as we seek and destroy our enemies. I hate that we missed that little detail....no kudos to the person(s) who skipped that part.

    Termlimits, (now term limits are a huge issue) I was merely pointing out that administrations current and past have used the "for reasons of national security" excuse over andd over to keep anything al Queda from seeing it's day in court. That would include today's story as well as the 9/11 story. How did you miss that?

    Termlimits, I was just pointing out that both the current and former administrations have used the "for reasons of national security" excuse for keeping anythin "al-queda" from seeing a courtroom where evidence would be shown. Like the FBI evidence showing that the trade towers were brought down by explosives. Or the fiorensic and video evidence that clearly shows it wasn't a jumbo jet that hit the pentagon. 9/11 victims family lawsuits would bring this all out into the light of day where we could deal with the ones resoonsible.
