A federal judge ordered that the U.S. military stop enforcing the don't ask, don't tell policy on Tuesday.
Judge Virginia Phillips ordered the military "immediately to suspend and discontinue any investigation, or discharge, separation, or other proceeding, that may have been commenced under the "Don't Ask, Don't Tell"."
The judge had previously ruled that the policy regarding gays serving in the military violated service members Fifth Amendment rights but delayed issuing the injunction.

The way the article is written, it is as though a US Federal judge has the ability to act in the capacity of the legislative branch.

All you people saying allowing gay people to serve openly would destroy the military? Guess what, it's been legal for people to do so in the UK since 2000. The same fears were brought up time and time again in regards to that. How many of them actually came to fruition? None, that's how many. The only news was that there was no news. The British military is just as competent, just as devoted to serving their country and just as ready to lay down their lives for one another as they ever were. If I fell and someone came to pick me up, I wouldn't care if they were gay or straight, black or white, Christian or some other religion. On the battlefield, that stuff doesn't matter. What matters is that you stick with each other and get the job done. A soldier in the field is thinking "Is my squad mate watching my back?" and not "Is my squad mate checking out my ass?" Any soldier who is thinking that clearly doesn't have their head in the game and shouldn't be on the battlefield.

i will serve on the front line..when I'm at the right age I WILL.i promise you that and i PROMISE you that if any gay looks at at me i swear to God they will suffer.
