Who does new immigration policy favor?

The Department of Homeland Security is going to begin reviewing all 300,000 pending deportation cases in federal immigration courts to determine which individuals meet specific criteria for removal and to focus on "our highest priorities."

Officials say immigration court dockets are clogged, putting public safety in jeopardy, costing money, resources and time. They want to see DHS enforcement resources diverted from illegal immigrants who don't have criminal records to individuals who pose a threat to public safety and national security.

So what does all this mean for illegal immigrants and what are the "highest priorities?"

In a memo, director of U.S. Customs and Immigration Enforcement John Morton lays out what circumstances should be taken into account when it comes to prosecuting immigration cases.

Morton describes some factors that should give cases a lower priority. Those include:

- veterans and members of the U.S. armed forces;
- long-time lawful permanent residents;
- minors and elderly individuals;
- individuals present in the United States since childhood;
- pregnant or nursing women;
- victims of domestic violence; trafficking, or other serious crimes;
- individuals who suffer from a serious mental or physical disability; and
- individuals with serious health conditions.

He also lays out negative factors that could lead officials to focus on certain cases. Those include:

- individuals who pose a clear risk to national security;
- serious felons, repeat offenders, or individuals with a lengthy criminal record of any kind;
- known gang members or other individuals who pose a clear danger to public safety; and
- individuals with an egregious record of immigration violations, including those with a record of illegal re-entry and those who have engaged in immigration fraud.

Morton also includes a general list of factors that lawyers, officers and other officials should consider when evaluating immigration cases. For a more detailed list of these factors read the document here (PDF)

  4. New policy favors fraud

    An illegal Mexican woman came to our city to visiit her "mentally challenged" boyfriend, who was here illegally working for an american construction contractor doing government work. She became pregnant, and by some strange quirl of fate, her child was born retarded. She hired a slick abagado (Mexican-american attorney specializing in sueing Uncle Sam) aand sued the city-owned hospital. She was awarded 750,000 bucks, and her retarded child has until his 18th birthday to file his own claim. And this was under existing policies, prior to being upgraded.

    "– pregnant or nursing women;" Do we really need to encourage them to breed even faster?

    AMAZING! We have 18 million Americans out of work, a stock market ready to crash, a possible depression, a $14 TRILLION debt and obama wants amnesty for the illegal aliens and all their anchor babies. I think it is time for this Muslim to be IMPEACHED!

    I've worked in construction with "legal" Mexicans and they are very fine workers. They also seem to have a slightly better attendance than American workers. I still think this country needs to start doing things that are sane. We shouldn't be rewarding anchor baby factories. If they get money for one kid they should be put on the pill. If they have another kid sorry. I'd like to see the inner cities get cleaned up before we start taking care of Mexico's problems. How would Mexico treat Americans that cross their borders illegally?

    Obama = 26%
    Congress = 11%
    According to a recent Gallup poll.
    We need new blood in Washington. This is getting insane. I'd almost be happy for a revolution at this point.

    What part of the word “illegal” does Washington no longer understand??? If an American does anything “ILLEGALE” they are punished, yet ppl from other countries come here “ILLEGALLY” they are rewarded… lets see the typical claim is they want a better life for their children and themselves… so cross into a country ILLEGALLY, work here ILLEGALLY, have babies here and have LEGAL residents flip the bill… how is this the voice of the AMERICAN PEOPLE… sounds more like the voice of those who think our county is a joke! For those stuck on race… ILLEGAL does not have a color just meaning… or did!
