PETA's killer whale 'enslavement' lawsuit goes to court

Lawyers for People for the Ethical Treatment of Animals will face off against those with SeaWorld in a Southern California federal court Monday after the animal rights group filed a lawsuit to declare that five killer whales are being held in slavery or involuntary servitude in violation of the 13th Amendment.

SeaWorld has called the lawsuit a baseless publicity stunt by PETA, which is known for provocative advertisements and public demonstrations on behalf of animal rights.

PETA filed the 20-page compalint in October on behalf of the whales - Tilikum, Katina, Corky, Kasatka and Ulises.

A PETA statement at the time contended that constitutional protections against slavery are not limited to humans.

    I wonder how many PETA peons own a pet or have a plant in their home. If this goes through, by virtue of setting a precedent, all PETA peons could be taken to court for enslaving their pets and plants for the same reason!

    I disagree with most of PETA's views and oppose most of their actions.
    SeaWorld provides a wonderful experience for children and adults.
    PETA provides almost nothing but trouble for humans who love other animals and understand the proper balance of all animals.

    On, I know, they’re not alive…

    That amendment does not apply to animals.
    Give m a break.
    In their effort to save animals, they have now come off as the dumbest organization on earth.
    Yet another example of a small demographic trying to force its will down the majority’s throats.
    They need to change their name to PETP, and focus their attention to the starving masses around the world.
    Let’s get a lawsuit going to protest taxpayer’s time spent on this in court.

      You made a good point about the frivolous court costs, banasy.
      There is tremendous suffering and need concerning human beings. Court costs for PETA's folly could feed poor children.

    This much I know, after visiting Seaworld in Orlando. Don't sit in the splash zone. Those animals make horrible body functions in the tank, then it splashes up onto unsuspecting fans. I've seen it happen.

    I have no idea what the iPad and/or CNN did with my comment. If you see this post duplicated again, blame one of them. What I tired to post was:

    Seriously? We are still working to make sure all people are being given their due Constitutional rights and now you want us to shift that focus to whales? I'm all for treating animals humanly but this is far beyond that. If we follow PETA's logic, race horses are slaves because we breed them, heck, any animal that is domesticated would then be a slave. Next they will be advocating to stop spaying and neutering pets because we are violating their rights by sterilizing them. They they will want all the house pets released because they belong in their natural habitats.

    Oh wait, they run a spay and neuter truck at the SPCA, silly me. Here I thought they wanted animals to live free and naturally.

    (Please excuse the sarcastic remarks, PETA just baffles me sometimes)

    If they were successful then all zoos would have to close, right? Any animal in a cage made to act for the enjoyment of humans. Pets, the circus, racing, who knows what else. Wouldn't that all have to go too? Good luck with that PETA.

    I heard roasted peta member tastes like pork. If peta is so altruistic, then they should volunteer for medical experiments. Has anybody ever seen a barefoot peta member? Leather shoes must be made of human hide. They love animals and hate people.

    I agree it is all a bit ridiculous. But maybe there could be some stipulation about capturing perfectly healthy whales. Like only keep ones that cannot live in the wild any longer, or breed them in captivity with whales they already have?

    Where do you draw the line? Are pet owners going to have to release their pets since they're basically slaves as well? What about police dogs? This case has no merit.

    PETA should be fined for wasting tax payer money. Someone has to get paid to look at this case, who pays them? Us. I say fine them.

    PETA has lost all of my support.

    I agree with CJR. I am an animal supporter with alot of different organizations but how in the heck can you try to stop this. Have you thought about what will happen if what you are pushing goes through? These animals will never be able to live in the wild, who's gonna take care of them then? If there is someone at the park that is mistreating them, then by all means fire them ASAP and fine them for animal cruelty but I cannot imagine anyone hurting these animals, not at Seaworld anyways. Have you done any research, the SeaWorld in Orlando does a show with only animals that were rescued from shelters. They have all kinds of rehabilitations set up for different animals. Do some research before you try to stop something that is helping animals. One of my dreams used to be to work at SeaWorld with the animals and maybe one day I will. I WILL ALWAYS support SeaWorld. You need to try and stop dog fighting or something where the animals are really being mistreated instead of something where they are being treated great.
