Special prosecutor will not use grand jury in Trayvon Martin investigation

[Updated at 12:11 p.m. ET] State Attorney Angela Corey, appointed as a special prosecutor in the February shooting death of 17-year-old Trayvon Martin, has decided against sending the case to a grand jury, her office said Monday.

"The decision should not be considered a factor in the final determination of the case," Corey's office said in a statement.

The grand jury, set to convene on Tuesday, was previously scheduled by the former prosecutor.

Corey previously said she has not used grand jury's in cases like this and added that from the time she was appointed she said she may not need a grand jury.

The decision about whether or not to charge George Zimmerman in the case now rests with prosecutors.

"At this time, the investigation continues and there will be no further comment from this office," in the statement.

The decision means that the timetable for any possible charges remains up in the air.

"We had hoped she had enough evidence without the need to convene a grand jury,” Ben Crump, the attorney for the Martin family said about Corey. “The family is trying to have patience and faith through all of this."

Crump said they are hoping for charges and an arrest as soon as possible.

"We know we want that day to come,” Crump said. “We want a very public trial so the evidence can come out and show people that the justice system works for everybody."

Crump added that he believed the evidence that has come out has “made it clear” that charges should be filed, without the need of a grand jury.

George Zimmerman's new attorney, Hal Uhrig, told CNN that he was "not surprised" by the announcement.

Uhrig said he doesn't know what her ultimate decision will be but that the move to go without a grand jury is a "courageous move on her part."

Martin ventured out from his father's fiancee's home in Sanford to get a snack at a nearby convenience store. As he walked home with a bag of Skittles and an Arizona iced tea, he was shot and killed by Zimmerman.

Sanford police questioned Zimmerman and released him without charges.

From there, the case has evolved into opposing allegations from Zimmerman's supporters, Martin's family and authorities.

Zimmerman says he killed Martin in self-defense after the teen punched him and slammed his head on the sidewalk, according to an Orlando Sentinel report that was later confirmed by Sanford police.

The case  has triggered a nationwide debate about Florida's "stand your ground" law - which allows people to use deadly force anywhere they feel a reasonable threat of death or serious injury - and race in America.

      @LILA- No there isn enough evidence to bring Zimmerman or charge him.t, dont you realize the law? Do you realize that Martin decided to beat Zimmerman and pin him to the ground and beat him until he broke his nose? The law "stand your groud" stands, which is why Zimmerman wasnt arrested. IT HAD NOTHING TO DO WITH RACE. I agree Zimmerman should NOT have followed Martin, but it happened. This didnt give Martin thr right to beat him and break his nose. Martin didnt deserve to get shot, BUT per the law IF Zimmerman felt his life was endanger, he can shoot and he did. End of story. They should look at changing the law YES, but the law was in affect. I am sure the blacks will riot because they ALWAYS use the race card anytime they can. Its sickening to me too. Whenever you see a WHITE GUY shot we dont riot or say its a race thing. Its BS. *** Hey black folks, do you now realize why you are viewed this way now? its because of always using the race card, AND YOU WONDER....

      Actually, the fact that you already have a special prosecutor looking into it makes the grand jury pointless. The case is already being investigated further. Ultimately it will be the special prosecutor who determines whether there is enough evidence to go to trial.

    Not going to the grand Jury is proof enough that the justice system works for everybody. Charging somebody with a crime because the race baiters want you too is unacceptable. If there actually was evidence that Zimmerman hunted daown and killed Trayvon like C N N would like people to believe, then I would be all for charging the man. The evidence clearly says that he was defending himself. Charging him anyway would open the flood gates of any punk thug wannabe attacking whoever they feel like and expecting to hide behind the race baiters if someone stood up to them. Good Job special Prosecuter for upholding the law and not bowing to the race baiters and racists like Al Sharpton.

    Read the article people. It does NOT mean Zimmerman is going free. It says, "The decision about whether or not to charge George Zimmerman in the case now rests with prosecutors." The grand jury that WAS going to hear it was picked by the former prosecutor who tried to cover it up. This prosecutor is saying, "No" to that grand jury. This person said from the beginning she probably wouldn't use a jury. "Corey previously said she has not used grand jury's in cases like this and added that from the time she was appointed she said she may not need a grand jury."

    First of all he is not white. Have to love black people. This uproar is going to screw things up to protect people who defend themselves. People are already going to jail and being sued because of people who get shot for breaking into their homes and defending themselves.

    If it's taken this long, the chances of an arrest / conviction diminish greatly. Just the pause alone would sit in a jurors mind, demonstrating the needed "beyond a reasonable doubt" and most likely end up in a hung jury.

    Why do they keep showing a 4 year old picture of Trayvon? Just use a current picture, he is a big strong football player that looks like an adult, this is a junior high picture, a lot changes in a few years of puberty. The media has been cherrypicking facts, splice-editing 911 tapes, and avoiding major information that supports Zimmerman's story for political reasons and to try to drive ratings. Just shameful media bias going on here. Lots of young black men die everyday from gun voilence, where is the anger there? Why just in this select case is their outrage? All of it is tragic.
