Special prosecutor will not use grand jury in Trayvon Martin investigation

[Updated at 12:11 p.m. ET] State Attorney Angela Corey, appointed as a special prosecutor in the February shooting death of 17-year-old Trayvon Martin, has decided against sending the case to a grand jury, her office said Monday.

"The decision should not be considered a factor in the final determination of the case," Corey's office said in a statement.

The grand jury, set to convene on Tuesday, was previously scheduled by the former prosecutor.

Corey previously said she has not used grand jury's in cases like this and added that from the time she was appointed she said she may not need a grand jury.

The decision about whether or not to charge George Zimmerman in the case now rests with prosecutors.

"At this time, the investigation continues and there will be no further comment from this office," in the statement.

The decision means that the timetable for any possible charges remains up in the air.

"We had hoped she had enough evidence without the need to convene a grand jury,” Ben Crump, the attorney for the Martin family said about Corey. “The family is trying to have patience and faith through all of this."

Crump said they are hoping for charges and an arrest as soon as possible.

"We know we want that day to come,” Crump said. “We want a very public trial so the evidence can come out and show people that the justice system works for everybody."

Crump added that he believed the evidence that has come out has “made it clear” that charges should be filed, without the need of a grand jury.

George Zimmerman's new attorney, Hal Uhrig, told CNN that he was "not surprised" by the announcement.

Uhrig said he doesn't know what her ultimate decision will be but that the move to go without a grand jury is a "courageous move on her part."

Martin ventured out from his father's fiancee's home in Sanford to get a snack at a nearby convenience store. As he walked home with a bag of Skittles and an Arizona iced tea, he was shot and killed by Zimmerman.

Sanford police questioned Zimmerman and released him without charges.

From there, the case has evolved into opposing allegations from Zimmerman's supporters, Martin's family and authorities.

Zimmerman says he killed Martin in self-defense after the teen punched him and slammed his head on the sidewalk, according to an Orlando Sentinel report that was later confirmed by Sanford police.

The case  has triggered a nationwide debate about Florida's "stand your ground" law - which allows people to use deadly force anywhere they feel a reasonable threat of death or serious injury - and race in America.

    Buying time to let the story fade into the background....I have zero TRUST for state officials in handling any case involving black people...they have historically and time and time again failed.

    Fact is, none of us really know anything. I lived and worked in the Sanford, FL area. I canvassed for FLPIRG (Public interest group). I know what kind of strange people live in these gated communities. They would follow me in gangs of 20 or more as I worked the neighborhood. I am white and I felt threatened in one of these communities.

    Ignoring skin color for as long as I can (I am only human, right?), I am thrown to believing this is an arrogant, cop wannabe, throwing his weight around – gone bad kind of situation. Gone way bad! He should be charged.

    I wonder was the 911 call intended as witness so to speak?

    Wish this never happened.

    My son is 17, much taller, weigh more than Trayvon & I don't see him being willing to wrestle / fight Zimmerman.

    The black community like Jessie Jackson and Al Sharpton get worked up about the wrong things, they show their own racism. they are barking up the wrong tree if they want to change race relations and make the black urban community stronger. The issues are not what these guy's make it seem, there are issues that need fixed but white are not the root cause of the issues, enough with that world view and look at the issues that are the real reason for the cycle of urban poverty like poor parenting, bad decisions, bad schools, etc.

    The whole truth & nothing but the truth will come out. NBC Producer already fired for editing the 911 call. I was not there but the whole thing stinks. Eye wittness from a third floor apartment looked out his opened window and said that he saw Zimmermen flat on his back, with a hooded person pounding the hell out of him. The picture of Martin where of a much younger boy, not yet a teen. Martin was at 6' 3" 140 lbs. from the Miami. Send to live with his Father while being supended ten days from school. His Father did not live in that complex. His girlfriend did. And there is more to the story yet to come out. I feel very sorry for Martins family.

    If Trayvon didn't want to anwser Zimmerman as to why he was there, then he could have just run to where he was staying. At 6'3" and 17 years old the fat 28 year old would not have a chance of catching up to him. If Zimmerman shot him in the back then off to jail he goes for murder. That young man just wasn't going to take any crap off of a fat Mexican so he attacked him. Why didn't he call 911 and say "there is a man following me" he had a cell phone in his hand.

    That's the spirit, have a trial to avoid riots. Blacks rioted in all the major cities in the 60's and 70's. They're 12% of the population and they can riot their heads off. They will riot no matter what happens and I've seen it before and could care less if they do it again. If there's probable cause they'll be a trial, if there'as not there won't. that's it!

    The story implies that Zimmerman just gunned him down while he was walking without any reference to Martin's assault on Zimmerman or any altercation. It's as though they want you to think Zimmerman lay in wait and just shot an unsuspecting Martin from a distance.....bad job CNN.

    I wonder... if Zimmerman had been white, would he already be in jail with a trial date set? I guess the black kid from out of town, trying to make himself feel important by gang-banging a white dude kinda didn't turn out the way he thougt it would? I wonder if poor little innocent Trayvon, who has never been in trouble, really is so innocent? Wow! ~ what a surprise to see instead of a white dude a Latino who be poppin a cap up yo azz?

    REally? CNN this is just bad reporting. Come on! YOu make it sound like Zimmerman just went up and shot him and that no confrontation ever happened.

    These racist posts here tell me one thing. The US deserves the black community to riot and cause as much damage as possible. Hell – shoot some white people too and claim "stand your ground". You really do deserve it. People outside of your country are watching this and are just disgusted with your views on people with different color skin and how you try justify it. America is the greatest country in the world? I cry BS to every inch of that statement. This all just proves that that you believe if you aren't white then you are sub-human. And you think that's right? Just? Proper? Enlightened? The way the world is supposed to work? When your society crumbles into the shambles that it's heading into, I won't bat an eye and declare that you reap what you sow and that you fully deserve it. Hopefully in the aftermath, hindsight will cause you to open your eyes to the civilized way of treating one another....otherwise you'll be all saying yes sir to your Chinese overlords when they show up and claim rights to your wrecked society.
