Colorado theater shooting suspect charged with 142 total counts

[Updated at 12:31 p.m ET] The suspect in Colorado shooting case has been charged 24 counts of first-degree murder.

There are three different classes of murder charges in the state of Colorado. One set of charges is because Holmes is accused of shooting after deliberation, referring to the planning of the attack. The second set of charges is because he is accused of having an attitude of universal malice, manifesting extreme indifference to the value of human life.

Holmes was also charged with 116 counts of attempted murder, one count that is a sentence enhancer because of violence and one count for possession of explosive devices.

Arapahoe County District Attorney Carol Chambers said last Monday that deciding whether to pursue the death penalty would involve input from victims and their relatives. A capital case would require a finding of either extreme indifference or deliberation.

[Posted at 11:30 a.m. ET] The man accused of opening fire this month inside an Aurora, Colorado, movie theater will have his second court appearance Monday, when he is to face formal charges.

James Holmes is suspected of killing 12 people and wounding 58 during a Batman film premiere on July 20. He is also being held in connection with the subsequent discovery of his booby-trapped apartment, which authorities think he rigged before the massacre in the Century Aurora 16 multiplex.

Holmes is to be led Monday morning through an underground tunnel that connects the courthouse to the Arapahoe County Jail, where he has been held in isolation without bail.

At his court appearance, which starts at 11:30 a.m. ET, he is expected to face 12 charges of first-degree murder, charges of attempted first-degree murder and charges related to the booby-trapped apartment.

In his initial court appearance last Monday, the 24-year-old former doctoral candidate - his hair dyed various shades of orange - appeared dazed and did not speak.

Arapahoe County District Attorney Carol Chambers said last Monday that deciding whether to pursue the death penalty would involve input from victims and their relatives. A capital case would require a finding of either extreme indifference or deliberation.

Authorities have remained silent about a possible motive in the case.

      DUI means 'Driving Under the Influence.
      DWI means 'Driving While Intoxicated.
      OWI means 'Operating While Intoxicated'
      The actual substance doesn't mean alcohol, just that your intoxicated in some way.

    I think someone should have tried yelling "hey you. Stop that" while he was doing the crime. It wouldn't of hurt to have tried.

      i know it sounds dumb, but as a school principal I have found something as simple as this often works. School children can be in an altercation and if you yell at them "Hey Stop" most times they will. It seems to trigger something in their subconscious that tells them they might ought no not be doing that. It causes them to pause a second and reflect on their actions.

    They would have to prove that the person is abusing the prescription drugs, such as taking too many Vicodans or Oxycotins or Somas, and intoxicated by them, to be charge with that OWI or DUI.
    Not merely taking a prescribe med in the prescribed manner is enough.
    At least in my state...

      And if the med says "don't operate a car or heavy machinery while taking this" and someone jumps in a car and does it anyway, they are not taking it in the prescribed manner and deserve what they get.

    Splitting hairs over what the difference between international and domestic terrorism are?
    Terrorism is terrorism no matter where you go. Just because one mans freedom fighter is another mans terrorist does NOT alter the definition of the word.
    If it is a terrible thing that was done, a terrorist did it. (same root word for 'terrible' and 'terrorists'.)
    What do these "vicious jerks" have in common? Not guns. Some of them use their teeth while under the influence.

    As im sure some think prison would be better justice and torture for him as oppsed to a quick injection, his prison life would consist of complete segregation and noone to bother him. So yes if he were to go to normal population (which he wont) it would be awesome, he would probably be better off eliminated asap.

    JEFF I guess there's dead, and then there's DEAD. OK. We seen Holmes' little convenient amnesia play. Everything from his I feel delerious look in court to his asking gaurds why is he being held. Whether he killed one or killed 142. Get him processed, sentenced, EXECUTED.

    You're charged with public intoxication and disorderly conduct. The substance is not necessarily booze. You could be stoned to the bone on pot and get the same charge if you're acting out.

    We, as a country have to recognize some people who are mentally ill have to go into a system and not be allowed to own guns. We have to take this seriously and say it is an illness or disease and treat it, cover it on insurance, have people who monitor the mentally ill, (make sure they are taking their meds, keep in contact with parents, siblings of the mentally ill, to make sure they are taking their meds. The research and study of these people and their brains after death need to be done.

    Yes. Seratonin inhibitor prescription drugs are supposed to be locked-up the same as guns. In case you didn't notice, virtually ANY citizen can buy a gun and a prescription for SSRI drugs.
    We need to close the loopholes in our drug and gun laws that allow for excess guns and drugs to be used during crimes.
