Colorado theater shooting suspect charged with 142 total counts

There are three different classes of murder charges in the state of Colorado. One set of charges is because Holmes is accused of shooting after deliberation, referring to the planning of the attack. The second set of charges is because he is accused of having an attitude of universal malice, manifesting extreme indifference to the value of human life.

Holmes was also charged with 116 counts of attempted murder, one count that is a sentence enhancer because of violence and one count for possession of explosive devices.

Arapahoe County District Attorney Carol Chambers said last Monday that deciding whether to pursue the death penalty would involve input from victims and their relatives. A capital case would require a finding of either extreme indifference or deliberation.

[Posted at 11:30 a.m. ET] The man accused of opening fire this month inside an Aurora, Colorado, movie theater will have his second court appearance Monday, when he is to face formal charges.

James Holmes is suspected of killing 12 people and wounding 58 during a Batman film premiere on July 20. He is also being held in connection with the subsequent discovery of his booby-trapped apartment, which authorities think he rigged before the massacre in the Century Aurora 16 multiplex.

Holmes is to be led Monday morning through an underground tunnel that connects the courthouse to the Arapahoe County Jail, where he has been held in isolation without bail.

At his court appearance, which starts at 11:30 a.m. ET, he is expected to face 12 charges of first-degree murder, charges of attempted first-degree murder and charges related to the booby-trapped apartment.

In his initial court appearance last Monday, the 24-year-old former doctoral candidate - his hair dyed various shades of orange - appeared dazed and did not speak.

Arapahoe County District Attorney Carol Chambers said last Monday that deciding whether to pursue the death penalty would involve input from victims and their relatives. A capital case would require a finding of either extreme indifference or deliberation.

Authorities have remained silent about a possible motive in the case.

      The key part of that sentence is HE, not the part about before the attack.

      It goes to show that he acted alone, and that he and not someone else rigged it.

      Rigged before .. whats wrong with that term ... It cannot be after, but what about some friends rigging it during the shooting .. So there is before, during and after , not writing when would create confusion, you know how we are .. we want clear facts. So it is actually good writing in my opinion.

      I believe it was reported this way because we live in a country where innocent until proven guilty is still the standard. They cannot report that he definitively rigged it, any more than they have to report he will be tried for the alleged shooting and killing of the people in the theater.

    Reading these comments on here "give him the death penalty" "eye for and eye" etc. etc. You are all just as pathetic as this guy is. How many people are murdered everyday in the U.S.? Just because he killed more then your average amount in a dramatic fashion doesn't make him any different they your everyday murderer. If you yanks had any brains in your thick pompous skulls you'd unite to ban guns entirely. But that would take some collaborative intelligence, something that lacks in the fading strong hold of the once good 'ol US of A.

      ban guns entirely? There are millions and millions of guns in this country. What do you think would happen if guns are banned??? SOME law abiding citizens MIGHT turn theirs in, but the criminals and psychos certainly would not. What would it accomplish?

    Why is justice so slow these days?

    He should have been charged 10 days ago, the morning after the crime. His trial should be over and done by September, not drag on through 2014.

    The trial of Timothy McVeigh took more than two years. Carrying out his death sentence took another four years. How does that make sense?

IMO mainstream media should treat this waste of DNA like the networks do when someone runs on the field during a sporting event – point the cameras away from him. Don't mention him by name whenever possible. Copycats take note; you'll be famous if you snuff out more than 3 people (any less, and it's second page – apparently – unless your victim(s) is/are someone famous). Some of you on here fan the flames for those waiting in the wings... "I need to see his face in court." No, you don't. Don't give him that power over you – and certainly don't demand more coverage of this maniac... IMO.

    Charge him with all the "counts" you want...the bottom line is wheather the DA is smart enough to handle the transition of the case (she is soon to leave her post due to term limits). It's the NEW DA who willl be prosecuting the case, and I bet he'll lose to the insanity defense...Verdict...life without parole...$20-30 million in appeals and $55K per year to house him. Pony up, Colorado.

    Why do we need to know how he gets to the jail or what life is like for him in jail. He murdered 12 people in cold blood with out any thought or care for their wellbeing, so why should we care. This is the way the justice system works you give up your freedoms in life when you compete a crime, that is the rules!!
