Kagan to be Supreme Court nominee, CNN confirms

 

[Update 11:06 p.m. ET] President Obama will select Solicitor General Elena Kagan as the Supreme Court nominee to replace the retiring John Paul Stevens, a legal source close to the process told CNN Sunday evening. 

The nomination is expected to be announced Monday at 11 a.m. ET, another source familiar with the process said. 

Kagan, 50, a New York native, was widely reported to be the frontrunner for the nomination. She was a finalist for the high court vacancy last year when Justice Sonia Sotomayor was selected to replace the retiring David Souter. 

Kagan would be the third woman on the nine-justice bench if confirmed.

[Posted 10:19 p.m. ET] NBC News is reporting President Obama will select Solicitor General Elena Kagan as the Supreme Court nominee to replace the retiring John Paul Stevens. 

CNN is working to confirm the report.

Kagan is a former Harvard Law School dean and has never served as judge. As solicitor general, she is the Obama administration's top lawyer before the Supreme Court and has argued several high-profile cases before the justices since taking the job in spring 2009. 

Kagan was a law clerk for Justice Thurgood Marshall and served as associate White House counsel in President Clinton's administration.

    Does anyone on here actually believe that we have three Equal branches of government? Personally, I've always believed that those in society with the most money, have the most power. Money talks, ideals walk. The powers that be, ie., the "owners of influence" will continue to run our country. Anyone else notice that Obama ran on a ticket based on less war, and more prosperity.... yet, the "powers that be" have kept the war machine going at full steam. Wake up people! Consider the level of corruption at EVERY level of government, and merely FOLLOW THE MONEY 🙂

    Remember Brown vs. Board of Education. The chief justice was Earl Warren. Earl Warren was never a judge before being nominated to be the chief justice of the supreme court.

    He did very well. Kagen might too.

    Seriously though, I'm just happy she was never a judge. Having been a jurist is over-emphasized. The court needs to be packed with ordinary people- like Joe Six Pack or Joe the Plumber.

    Kagan is NOT gay (not that it should matter), contrary to rumors that were started at the beginning of the consideration process. Also, she is brilliant, which is more than I can say for the infantile posters on this board who can't see past her appearance. Do you realize how it looks when your spelling and grammar error laden posts focus only on how she looks? This superficiality is appalling and a sad indictment of your screwed-up priorities.

    Don't ask ... don't tell ... is at work in the Supreme Court selection process. Don't get me wrong, she's got the legal chops for the position.

    If gays keep quiet about this nomination, maybe they won't blow it.

    We go from a president with very little experience in elected office to a supreme court judge with absolutely no experience as a judge. But, hey, she's already a loyal Obama employee; and, she comes from Harvard. From Obama's point of view, she's perfect.
