Kagan to be Supreme Court nominee, CNN confirms

 

[Update 11:06 p.m. ET] President Obama will select Solicitor General Elena Kagan as the Supreme Court nominee to replace the retiring John Paul Stevens, a legal source close to the process told CNN Sunday evening. 

The nomination is expected to be announced Monday at 11 a.m. ET, another source familiar with the process said. 

Kagan, 50, a New York native, was widely reported to be the frontrunner for the nomination. She was a finalist for the high court vacancy last year when Justice Sonia Sotomayor was selected to replace the retiring David Souter. 

Kagan would be the third woman on the nine-justice bench if confirmed.

[Posted 10:19 p.m. ET] NBC News is reporting President Obama will select Solicitor General Elena Kagan as the Supreme Court nominee to replace the retiring John Paul Stevens. 

CNN is working to confirm the report.

Kagan is a former Harvard Law School dean and has never served as judge. As solicitor general, she is the Obama administration's top lawyer before the Supreme Court and has argued several high-profile cases before the justices since taking the job in spring 2009. 

Kagan was a law clerk for Justice Thurgood Marshall and served as associate White House counsel in President Clinton's administration.

    Replacing JPS with this choice is sad for the judicial system... JPS had a judicial and legal mind, and this one will be nothing more than an administrator with a high job. So, is the quota filled yet? Why can't the President appoint a democratic equivalent of a Roberts or Alito who are very smart legal minds in their own rights? Sotomyor and Kagan pale in comparison to these judicial minds. There goes well-articulated decisions and dissents. As an independent moderate who leans a little left, this is a sad day for the court.

    If words were weapons of war, Obama's prose could have destroyed the world a thousand times over. Actions, not words, will define our country for what may become an increasingly less desirable existence. From my understanding of the fall of the Romans, the French and for that matter the British Empire.... our county has nowhere to go but downhill : ) Sad, but true.

    I hope Obama gets the opportunity to pack the court. Hopefully Roberts or Alito will have a painful widow-maker and choke on their tongue. I would love to see one of those guys foaming at the mouth.

    Nice to see that Obama is choosing to employ crony-ism by nominating someone with a Chicago connection who has ZERO judicial experience. That's not too say I don't think she could potentially make a good justice but I don't know if she'll be approved by Congress since she doesn't have a judicial record they can review.

    So will Michelle Obama still go around talking about obesity when her husband is promoting a woman who is like 200 pounds over weight? These people bend what ever rules they have for what ever situation they are in. Stand for something and stick by it...
