Judge blocks part of controversial Arizona immigration law

A federal judge has blocked one of the most controversial sections of a tough Arizona immigration law, granting a preliminary injunction Wednesday that prevents police from questioning people about their immigration status.

That provision required police to "make a reasonable attempt to determine the immigration status of a person stopped, detained or arrested" if the officer has a reasonable suspicion that the person is in the United States illegally.

U.S. District Judge Susan Bolton's ruling, in response to a motion filed by the federal government, came with scant hours to go before the law goes into effect.

She also blocked provisions of the law making it a crime to fail to apply for or carry alien registration papers or "for an unauthorized alien to solicit, apply for, or perform work," and a provision "authorizing the warrantless arrest of a person" if there is reason to believe that person might be subject to deportation.

"We believe the court ruled correctly when it prevented key provisions of SB1070 from taking effect. While we understand the frustration of Arizonans with the broken immigration system, a patchwork of state and local policies would seriously disrupt federal immigration enforcement and would ultimately be counterproductive," the Department of Justice said in a statement. "States can and do play a role in cooperating with the federal government in its enforcement of the immigration laws, but they must do so within our constitutional framework.

"This administration takes its responsibility to secure our borders seriously and has dedicated unprecedented resources to that effort. We will continue to work toward smarter and more effective enforcement of our laws while pressing for a comprehensive approach that provides true security and strengthens accountability and responsibility in our immigration system at the national level."

Seven lawsuits are seeking to block implementation of the law, signed by Arizona Gov. Jan Brewer in April. It is to go into effect Thursday.

The law also targets those who hire illegal immigrant laborers or knowingly transport them.

Opponents say the law will lead to racial profiling, which is illegal.

Supporters point out that the law prohibits racial profiling and people cannot be stopped and asked for proof of legal residence based solely on their looks.

    The Democrats which i used to be a conservative democrat until weeks ago oppose this law to secure a large voting block. However the Obama Department of justice is actively seeking ways to waiver Military and Overseas Voter Empowerment (MOVE) Act. Here we are, the DOJ is trying to protect illegals but on the other hand trying to deny our men and women serving in a war zone from having their votes count on technicalities. Even the most liberal democrat should want the the votes of military personnel to count and not be thrown away because theya rrive late. The MOVE Act was to prevent this but the DOJ is actively assisting atates to waiver their compliance.

      Liberals have had a long dislike (if not hatred) for the military. We tend to be much more conservative, which that alone garners such disdain from the self proclaimed "intellectual" liberals. They see us as beneath them and certainly wouldn't want our votes to in any way hinder their agenda. Al Gore tried to block military absentee votes in Florida during the recount because he knew that those would be votes against him.

      Dear man, if you read the reforms for yourself and stop relying on the mouth-breathers to tell you what it says, you would discover it is NOT a weakening of military votes, but rather a way to safeguard the ballots with time frames to make sure they are counted even with delayed arrival due to things like, oh, war.

      The holdup is the sheer number of states applying for waivers to keep from following the MOVE provisions (as passed) and the improper way they are filing for those waivers. Basically, none of the states filing want to comply.

      hey pedro... illegals do vote because some of the people registering them to vote use a list of deceased voters and give them new names. convicts, who by federal law are not allowed to vote, voted in minnesota and got franken elected. many people cast more than one vote in different districts. did you fall off the watermelon truck after the 2008 election? this stuff happened and was covered extensively by FOX news and less on other networks but it was, and is, still the case.

WND and Fox News are at the top of the list. And what follows is literally two pages full of insane right-wing blogs that say the *EXACT* same thing. That's some good "reporting" there, Lou.       Considering myself, and no "left-wing" news source. I have to ask why the "Obama Administration" is looking to "not allow overseas military members to vote" when it was President Obama who signed MOVE into law in the first place? I'm sure those unbiased right-wing sites have a good non-conspiratorial answer for this.

      @Victim – Al Gore did nothing illegal and tried to get votes remove that did not stand up to Florida law. His VP running mate spoke out shortly after conservatives started raising hell about it and said that they should just go ahead and count all absentee (military and non-military) votes even though many of them violated Florida law. Everything done in that election by the Al Gore campaign was perfectly legal and allowed by Florida Law. If you lost an election by less than 600 votes would you say "no" when the state of Florida tells you that you can ask for a recount in three counties of your choosing? Would you not question why over 12000 "inmate" ballots were thrown out even though they met Florida law with respect to convicted felons voting *and* were thrown out by office holders who were in the opposing party? And you wouldn't say anything when a higher court, populated in the majority by judges chosen by opposing party members, decides that a Florida law, which has been in place for years and years, is simply invalid and that you have to stop doing what that local law provides? You wouldn't say anything and just simply concede the election? Really?

      I'm a liberal, and I don't dislike the military. I don't like wars. Especially wars that are unjustified, self-serving, and misguided. Wars kill soldiers. I don't want to see the lives of our military men and women squandered by politicians who are more interested in making money for special interests than doing what is right for the country. The Iraq War was nothing but a massive boondoggle that benefited contractors and big corporations above all. As usual the military got the stuck with the real cost, paid for in the lives and dreams of American soldiers.

      Illegal immigrants from Mexico really, really do not vote. They are too busy working to provide for their families and staying under the radar to avoid deportation. But if they voted, they would vote right along side the Republicans. Mexicans, in general-especially the poor, are very, very conservative. So, even if a few brave illegals slip through the cracks and vote, they will most likely vote for republicans. Ironic, don't you think?

Why did Republicans fail to enact reform when they controlled both Congress and the White House for 6 years? How can Obama be blamed after only serving as President for 1.5 years while George W. Bush failed to accomplish the same thing in 8 years?

      Why is this so hard to understand? Why all the hoopla, gnashing of teeth and pushing for means and methods that subvert federal law? You lefties are making it harder than it has to be.

      However, with that said, let's talk about your statements like "doing the work whites won't do"...where do you get that from? "Whites" (and keeping with "PC" labels, please refer to us as "Anglo Saxon-Americans" in the future) will take employment in any legite job available. You might be surprised by how many actually like some of that dirty work. I love to mow grass, I'd gladly take a job doing that, but I have a wife and children that I have an obligation to provide for, so I took it upon myself to get an education while serving my country for 24 years in the military. I retired from the military and now have a good paying job because of the long hours I spent getting that education and the years of service I used to implement what I learned. I was able to get that education through the military, otherwise I could never have afforded college. I have been a ditch digger, dish washer in restaurants, etc. It is certainly not beneath me to do that work when a job is needed, but I aspire to something higher and do what it takes to get there.

      There are many, many Americans that think similarly and do the same things, so attempting to validate the presence of illegal aliens in this country by saying they will do the work that Anglo Saxon-Americans won't do is complete BS.

      I support anyone that has goals of bettering their lives for their families and themselves, but they also need to follow the rules and the laws in that journey to the greener pastures.

      Bolton was nominated to the United States District Court for the District of Arizona by President Bill Clinton (Dem). Giving a little back for getting the job (ruling). To the people who talk of profiling. When I was younger I had long hair and in the town I grew up in if you had long hair you possessed drugs. I used to get pulled over at least twice a week, at least (never arrested though). Profiling occurs in many different ways, it just depends on the crime and who is typically committing it. And I have a question, why don’t Mexicans protest in their own, corrupt country? Mexico could be a great country if the people did something about it.

      Any hopes that the Democrats had that this issue would be shoved to the back burner is very likely over. I think this could hurt Democrats in the fall.

      Personally, I can understand the concerns about racial profiling. On the other hand, the people of Arizona an several other states are frustrated. They cannot continue to afford the high costs associated with the influx of illegal immigrants, criminals, drugs, etc. across our nation's border.

      Does it really matter what the polls have to say? Arizona is always a red state anyway and Obama still won! I, for one, am opposed to this law anyway. It's easy for anyone to demonize a class of people that just wants to flee the oppressions of a third world country so that they can come make a better living for them and their families. If so many Americans weren't so lazy and living off the system now then there wouldn't be a need for illegal immigrants to come and do what they have to do to earn a buck. This law is clearly targeting Mexicans and racial profiling would surely persist. Somehow, white people can't understand that this country was founded by immigrants that tore the land from Native Americans who have now been ripped of THEIR land. NO TO ARIZONA'S NEW LAW! They were in power, yet did not dare tackle the issue. Too many corporations donate to the republican party that would be upset by this. They preferred to back the fence. Did your ancestors come here legally? Of course back then there was no set government or way of becoming a citizen but this wasn't your land.       Now you want to try to tell me about filing for citizenship legally? Well, unfortunately, we all know that system is crap. I know of people who are not in this country but have been waiting for over 25+ years to get so much as a call back to say they are moving forward with their application. Definitely a system that needs to be broken.

      For any of you that say that Mexico is run down and horrible and you would never go back, that's just fine. There's certain parts that I wouldn't go to either. But all in all, Mexico is a beautiful country with a rich culture. Heck, we all know there's part of the USA some of us would never travel to.

      So keep this in mind...this land was never mine, nor yours. So don't get mad that karma is just coming back to bite you in the @$$

    Glad to hear it. I have a home in Arizona but do not believe that the state has the right to usurp the rights of the nation. The immigration issue needs to be addressed and I think we are doing a lousy job of controlling illegal immigration but sending street cops to do the job is not a good idea at all. Do you not realize that most illegals us fake SS numbers to get jobs. And that when they get paid the payroll tax money goes into the system for which nobody every claims. Then you may be surprised to learn most illegals file tax returns with there fake SS numbers.

      Secondly, if you want to get rid of illegals, then why don't you ask your landscaper and your maid to show you their SS numbers and then have them verified by the SS administration. Why don't you stop shopping at Walmart and the other corporations that hire illegal immigrants. If we enforce the laws that require business to verify SS numbers then most illegals could not get a job.

      But remember when you do this the prices at Walmart and other stores will go up. Your landscaper and your maid will be charging you more. The food in your grocery store will cost you more. Your taxes will go up because there will be less revenue from illegals. And finally, so that they can get back home, illegals will show up at immigration and turn them selves in so that government will pay a trillion dollars to ship them back to each of their countries.

      If they are paying RENT, they are indeed paying property taxes through their LANDLORD (who pays that property tax based on the rental units owned). We used to add a percentage to the rent we charges on a remote property specifically to cover those taxes.

      Using the argument concerning property taxes, it seems *some* mouth-breathers would deny an education to any child whose parents do not own their own homes.

Many of those "fake" SSNs are really SSNs of other people. Not funny if an illegal is using your SSN or your child's SSN to get hired.       This law was blocked because there is a a margin for error. In our country, we should never implement a law that could result in innocent people being affected.

      Now, for another famous misconception: illegals DO pay taxes. If they work at MacDonald's taxes are withheld from them automatically. However, if they work in the fields and they get paid cash because their employer is not declaring it, then who is braking the law? Also, illegals pay taxes every time they purchase a gallon of milk or food or clothing. They are paying taxes without ever getting an income tax return in most cases.

      Don't like illegal aliens? Tell MacDonald's you will not buy that burger until they stop hiring illegals. Don't go to the restaurant where the dishwasher or busboy looks illegal.(who cares if he's an american citizen. He only has to LOOK illegal, right?) Don't take your car to the car wash that employs illegals. In short, boycott all businesses that employ what appears to be illegal labor. It's your right.

      The comments that LEGAL immigrants built this country are funny because the "legal" immigrants who first arrived in the US came when there was no actual law in place. In response to those who seem confused about the argument the federal law cannot be usurped by state law: the examples about kidnapping or bank robbery are inapposite. If someone is kidnapped, the local authorities have the ability to act, just like, WITHOUT the Arizona immigration law, authorities also have the ability to act albeit with certain limitations. The point up for debate is the limit of what laws states can pass in areas that are under the purview of the federal government and whether those laws conflict with the role of the fed. I for one, think this law is plain irresponsible whether you are for or against reform. It is utterly ridiculous that Brewer signed into law a bill where police are mandated to determine status (under certain situations that I won't go into) and provides for the police to be SUED if they aren't being aggressive enough in fulfilling the mandate. So much for tort reform! With that opinion, however, I like hearing other POVs as long as people aren't straight making stuff up and totally exaggerating. All the dramatic comments about marxism and states rights are uninformed, unhelpful and misleading. That's why stations like Fox can get away with direct lies– no one is fact checking

      It's called a drivers license, proof of registration (vehicle), passport, SSN card, etc., and btw it takes only a few minutes. Any law enforcement official can ask for at any time, check the laws, they don't abuse it due to harassment issues. So how is checking for this illegal of anyone of any race? If they can't provide any information then the LE official can proceed to down the illegal alien/immigrant questioning detainment. In other countries you're automatically thrown in prison, let's see, Mexico is one.

I have a friend whose family has lived here for at least a few generations, but because he's Puerto Rican, he somewhat resembles a person of Mexican desent... he's a citizen... should he have to produce paperwork to prove it?

      ID and proof of citizenship aren't the same thing.

      Do you carry your passport or birth certificate with you everywhere you go? If you're a US citizen and don't, the Arizona police could have held you in jail until such time as you were able to present one of them (or some other proof of citizenship).

      I understand the intent of what Arizona was trying to do, but that part of the law was overly broad and would have been easy to abuse. It makes sense why a Judge would have issues with it.

      Note that the entire law hasn't been struck down, just parts that were overly broad and the parts that are in conflict with Federal law.

And while most folks are feeling bad about the Hispanic immigrants here illegally, they forget there's a huge block of our enemies (known as terrorists) that love that our borders are porous.
