    Oh well... What about the person that might have slipped on the wet floor that she just created... can they then sue her? She needs to get over it and move on. I just wonder if she dives the way she walks... she is a danger to herself

    She is damn lucky she wasn't on the third floor of the mall and took a trip over the rail.

    The serious part about this is someone internal to the mall copied the video tape and released it to the world. The security cameras are there in case of a crime. This could be considered tampering with evidence.

      Wrong. She was is a public space. the mall is private property, but there is no expectation of privacy in the common areas of the mall.

    Those are crocodile tears the texting doofus is producing (on cue). She's playing it up in order to get money (her lawsuit) and attention (her five minutes of fame). She is unrecognizable in the video. If she hadn't willingly placed herself in the spotlight, no one would know who the fool in the fountain was. The video is hilarious, and it's amazing that someone who worked in the mall would be so oblivious that she could do a faceplant in the pool. I'm surprised she isn't claiming injury to more than her pride. There is no way she should get money out of this. Funny security videos are aired all the time. Furthermore, she was in a public space where there was no expectation of privacy.

    like when you trip and look around to see if anyone saw you. Well everyone saw you missy, the only thing hurt were your feelings. And that is no reason to sue...I'm sorry, but that was just too funny for the world not to see! Plus it shows that if an adult can't walk and text, how can we expect our children to drive and text??

    If she can't walk and text then god willing she knows better than to drive and text. As far as a lawsuit the mall didn't do anything wrong to have a lawsuit put on them. I guess they have to start posting signs. Mall not resonsible for accidents caused by your stupidity

    This is another example of driving while texting, or in this case "walking while texting". She just wasn't paying attention, and now wants to sue someone?? Her case should be dismissed before it even begins!!

    I think texting in a mall might not be too bad, but what really bothers me is when people are walking on the sidewalk or crossing an inetersection while texting. If you are on a sidewalk and texting, you could get distracted and go on the street. If you are crossing an intersection and texting, you wouldn't notice if someone is coming at high speed and can't stop. Falling into a fountain isn't too bad compared to that.
