This is 2011. Google maps can get a photo of you sneaking out in a bath towel to grab the paper from your own front porch. This woman learned a valuable lesson: We have eyes in our head for a reason. She has no basis for a lawsuit unless she sues herself for being stupid.

Big thumbs up to Joan Rivers for getting banned from Faux News. Faux is as useless as pile of fecal matter as exists in the electronic noise that passes for "news" these days and they are not worthy of a talent like Ms. Rivers.

This woman needs to sue herself. She was the one who had her head up her butt. It wasn't anyone else that was texting, just her. If a judge rules in favor of her then the law is full of BS. The mall or anyone else didn't make her fall, she did. It just goes to show you that a woman can't walk and talk, just like they can't drive and talk

It's her own dumb fault. If she tried to sue she'd loose big because it's the mall's footage to do what they want with it.

I am baffled by the fact that all news channels ONLY show half of the video. Then they show her with a lawyer telling her side of the story and how nobody came to her rescue. What bull... Cafferty.. get on this now and demand that CNN shows remainder of video where it specifically shows same woman from 2nd camera where she falls and gets up and walks to nearest store where a janitor with a bucket came to check up on her. All of it is on video. Show THAT to america and make a fool of her.

She has no right to sue anyone because a-her face was never shown in the video. b-her face was never shown on 2nd camera angle c-it hit youtube and what happens on youtube stays on youtube. Obviously recorded by someone under age of 30 judging by voices and guess what.. the only person who came forward was her. She did not have to do it. Get up, get going, dry up, go home and change and be embarrassed and have a laugh. Instead she is like ooooooo I want to sue everyone and everything.

Does anyone else notice she lifts her leg up more than regular walking would? Right as she gets to the edge she lifts it but is a little short and that's where she trips. Looks like something was planned to me and that would explain why others did not apologize as well. Just seems a little odd to me that she would lift her leg that high just to walk.

It's the fountains fault for being in the same spot for the last 20 years, wasn't the first visit to that mall for the Ms. Freak Show.
She deserves to be on YouTube. Camera's are everywhere now, you have to know that, it's the world we live in.

No one came to her rescue because she immediately got up and walked out of the pool.
She wants to file a law suit with mall? Maybe they can settle out of court and give her a swim suit.

This should be a lesson to everyone that texting and walking can have the same results as texting and driving. Don't!!!

Stupid woman!!!!! You are a bad examples to the youngsters. How dare you even think of suing when your mishap is a result of your stupidity. You should be thankful, you were not on the road texting. You would have been run over by a car, worst 18-wheeler truck. Accept it woman, you made a terrible mistake for your embarassment, and worse you revealed yourself with the CNN interview. How dumb!!!!!!

Tom B–You could clearly tell in the video that the woman was not hurt. She picked herself up and walked away! I'm sure that if she had remained floating face-down in the fountain someone would have come to her rescue. But her lack of attention to the world around her only bruised her dignity and wet her clothes. Certainly something to laugh at!
