Lady Gaga threatens to sue over 'Baby Gaga' human breast milk ice cream

Lady Gaga has threatened to sue the makers of an ice cream made from human breast milk if they don't stop selling the product under the name "Baby Gaga."

News of the flavor's sale in a London sweets shop by a waitress dressed like Lady Gaga raised eyebrows worldwide and led to its confiscation after the Westminister City Council deemed it unfit for human consumption.

That hasn't stopped the meat-wearing entertainer from accusing Covent Garden's Icecreamists of riding her "coattails" to promote a "deliberately provocative" product that many consider "nausea-inducing," according to legal documents filed on her behalf.

In using her name and her image, Gaga - whose real name is Stefani Germanotta - accuses the shop of misleading the public into believing she endorses the concoction of breast milk, vanilla pods and lemon zest.

"The references you are making to Lady Gaga are thus clearly deliberate and intended to take advantage of her reputation and good will," the document states.

Furthermore, "associating the Lady Gaga mark with a food product which may be unsafe for human consumption (owing to the risk of it carrying such viruses as hepatitis) is also highly detrimental" to her brand, according to the document.

Gaga demands that Icecreamists change the name of the ice cream to something that is not "aurally, visually or conceptually similar" to Lady Gaga and to remove all references to Baby Gaga from their website and marketing materials or face an injunction and further legal proceedings.

The owner of Icecreamists, Matt O'Connor, said he intends to fight the allegations, which he calls "preposterous and outrageous."

He also said he plans to continue selling the breast milk ice cream under the name Baby Gaga if he gets the ice cream back from the council.

"We think this is very unnecessary, the whole thing will be over by next week, but we are prepared to fight this in court," he said.

Apparently, she's not into baby talk–googoo gaga–has been used since I was a child to depict baby talk particularly in cartoons, comic strips, etc. Name is appropriate for the product–perhaps she should of thought of this before choosing it as a stage name.

To all the idiots who claim that Lady Gaga "stole" the name "Gaga" from a Queen song containing that name–"Gaga" is a very old (late 1800s) term that means "crazy" or "wild"–Its in the public domain. It originated in English from French slang. "Lady Gaga", however, is a trademarkable name that nobody has used before. So, yes, she is entirely within her legal rights to try to stop the use of this name.

Why...because she didn't think of it, herself? Aw, good grief, more useless litigation.

If you ever had a brand or name to maintain you would sue for it too. But you don't because you are forever a loser.

So how do they get enough breast milk to make all that ice cream? Imagine having a job on that production line 🙂

Its not about the name baby gaga its about using her image/name to promote a product that shes not involved in. Lindsay Lohan had a similar suit last year against e*trade who used her image in an ad. Also I hope they pasteurize that milk. 😛

All the crude remarks about Lady Gaga are really horrible. She is very talented and can sing..and does. She has more money then most of us combined so she must be doing something right... She chooses to express herself in a different way, that doesn't make her a freak...it makes her unique. I like her and her music. I would be thrilled and honored if i ever had the chance to sing with her. Don't make fun of someone just because you don't understand them. Dare to be different.... i like that phrase....

Some of you folks get it and some of you don't. First of all, the ice cream people are saying "BABY Gaga", not "LADY Gaga". Similar, but not the same. Also, how do we know that the waitress is trying to look like her? Is she the only person on Earth who dresses outrageously? I like Lady Gaga, but she'd better watch it with these lawsuits. It's not like she needs the money! Oh, by the way, Melissa Murphy – just because people have lots of money doesn't guarantee that they did something right. It just means they're rich. All that mindset does is glorify materialism and try to shame people into working harder, which isn't what life should be about.
