Toobin: Judge made statement with Anthony sentencing

CNN legal analyst Jeffrey Toobin calls the four-year sentence Judge Belvin Perry slapped on Casey Anthony a surprise but says the judge likely was making a statement in giving her the maximum jail time.

Perry on Thursday sentenced Anthony to one year behind bars on each of four counts of lying to police concerning the death of her daughter, Caylee. She also was fined $1,000 for each count.

“Most people convicted of misdemeanors do not get prison time in Florida or anywhere else," Toobin says.

Despite the sentence, Anthony won't spend much more time incarcerated. She got credit for the time spent in custody since her arrest, almost 1,000 days.

Before the court gave Anthony's official release date, Toobin speculated that she could be free in less than two months once credit for good behavior also was considered. But it appears Anthony got a bigger break - she'll be out in a less than a week. A court spokeswoman said her release date would be Wednesday.

Anthony has served about three years already. And it seems, Toobin said, the judge was intent on making sure some kind of punishment had been handed down in the case.

"This judge was clearly appalled at the nature and content of the lies Casey Anthony told to the police," he says. "We are all reminded about just how sinister and awful these comments were."

Authorities said Anthony lied about whether her daughter was missing. Her other lies included claims that Caylee was in a nanny's custody, that she had a job at Universal Studios and that she had received a phone call from Caylee.

Toobin said that while Anthony's criminal law troubles may be over, she could be involved in civil litigation much longer.

Zenaida Gonzalez has filed a defamation lawsuit against Anthony. Authorities questioned Gonzalez in Caylee's disappearance after Anthony said a nanny by that woman's name had kidnapped the child. Gonzalez denied ever meeting Anthony.

Florida officials also are asking that Anthony repay the state for the enormous cost of investigating the case. A private firm that helped in the child's search wants its money back, too.

Lawsuits could linger for years, Toobin says, but he doubts they'll have much effect.

"I will be surprised if Casey Anthony ever ends up paying anyone," he says.

    She was over charged. I was worried about this from the start. Some kind of second degree was the most I could see. It was a really dvmb accidental death with a "chemical babysitter." You can lay a lot of the blame of the prosecution. I never really bought the whole duct tape thing as proof of 1st degree murder.

      Totally agree, I never bought into it, in fact its just not a case I've really followed all that often anyway; The prosecutor painted such an elaborate schema, with nothing much to support it. Tragic accident, negligence, wayward mother, lies that spun out of control, coverup – that I think the jury would have accepted.

      No such thing as overcharging in Fl. In Fl. you can be charged with multiple severities of offenses and she was charged with the whole range, from murder 1 to manslaughter and the jury could have found her guilty of any of those charges. The jurors were just plain idiots.

      She wasn't overcharged. The jury is usually given more than one charge to consider. This jury chose none of them, and that is appalling. I only hope Casey's next tattoo reads, "Life Sucks."

    Steps For How to Get Away With Murder in Florida:
    Rather than hire a sitter, knock your 2 year old kid out with drugs.
    Pop her into the trunk of the car and go party the night away.
    Do it frequesntly. Works well.
    Dont forget to duct tape her mouth shut in case the drugs wear off and she wakes up and cries.
    Duct tape her hands shut too, jjust in case.
    Go home with someone and leave the baby in the trunk longer than planned.
    Uh OH!! Remember the baby next mornign or around noon the next day when its 90 degrees plus.
    Keep the body in the car until you figure out what to do and go off to another party and get a tattoo.
    Dump the body not far from the back yard.
    When Mommy and Daddy ask questions, lie.
    When the cops ask questions, lie some more.
    Now blame Daddy.
    Look innocent in court.
    Hope and pray for a stupid jury.
    Celebrate the fact no one could REALLY prove anything.
    Party on and write a book , maybe a talk show. Piers Morgan show. Movies?
    Have another baby!!!!!!!!!!!!!!!! It's a beautiful life.

      this statement is all sooooooo true and shows how outrageous this verdict was. I can't stand to hear the jurrors saying "we couldn't convict, there was not enough evidence"–what did they require to convict..they spoke of no DNA. Hello? did they not hear that the body was underwater in a swamp all that time the police were on a wild goose chase due to Ms. Anthony's LIES? Maybe if they had been a bit less interested in going home and alot more interested in going through the facts and the evidence, they could have arrived at a more just verdict instead of letting a killer walk free.

    Did I hear a juror say that they had voted 10 to 2 to convict then they changed after some discussion was the discussion , that someone had to go on a cruise on July 7 an did not want to waste time doing the penalty phase and the other two who said that that could not judge anyone, but was put on th jury anyway. How big is this town that these people came from that they do not know what child abuse or child neglect is. You can't judge but you can let someone who kill or know who killed an innocent child go free. Whenever there is anything including Casey in it I will not be watching or buying to help support a baby killer.

    She doesn’t have remorse for what she have done and for her it was great to kill my child and found not guilty (see her reaction after the verdict)… take note this woman is a psychopath and all she care is herself and she doesn’t have feelings with her parents as well… I don’t blamed the parents of this woman they did what they can to raised her but she is sick and sometimes parents are in denial of what kind of a child they have and take note they were the ones who told the police that their child is a psychopath… that means they know their child… my heart goes to this woman’s parents who until now suffered the lost of their beautiful, sweet, angel grandchild who is very innocent and full of life and someone just took her breath away… huhuhu 

      What the parents lied about?... as far as I know it was the mother who phoned 911 screaming and telling them what happened (the trunk smells like there was a dead body on it)… at first they believed what their child told them which most parents would do and later on they knew she was lying and the reason why they were mad was because the people harassed them every day… I’m sorry I don’t know this people… I’m only one of those people who follow this issue because my heart breaks every time I see a child murdered… as you can see the parents were not happy on the verdict as well and until now they are not talking with their psychopath daughter… they knew she doesn’t have respect for both of them… for her they are only one of us…

    I hope everyone sues her, especially for all the time and resources spent looking for the child while she was misleading them all over the place, and that she never sees a penny of all the book deals and stuff that will inevitably be handed to her.

      Unfortunately; because just like she will never admit responsibliy for this child's death, she willl never see that she wronged all the people who want to sue her. She has no conscience. She really thinks she did nothing wrong. Nothing. And so I don't see her ever paying monetarily anyone that she owes.

      Rarely does that ever happen that i've ever heard, that is a determination made by the Department of Justice or Corrections, I can't quite remember. He just issues the sentence.

    I agree with Paul, I heard she already has an agent and her parents are taking bids to see how much they can get for the first interview, personally I think the whole family is sick, lets hope it is a rumor. I guarantee you will see Casey making some serious money, someone is going to pay big money to talk with her, then there will be the book deal, usuallt works this way, sad but true....

      If the lawsuits come to fruition, she will likely have to pay any money she receives from book deals, interviews, etc. Just like OJ did. Oh wait. I guess the Goldmans are still waiting for the money they won in the civil suit. There does seem to be another hole in our judicial system.

    I guess I'm not understanding..Let's say for argument sake the child did drown in a pool as the defense states. Shouldn't Casey get some sort of punishment for hiding that fact and not getting help ASAP? Plus the body was taken to the woods by SOMEONE. If the father helped with that shouldn't he be tried?

      That is exactly what is perplexing me. If the defense lawyers are floating the idea that Caylee drowned in a pool, then one of these two must have carried the kid away after drowning, gagged her ( God knows why?), dug a hole with the borrowed shovel and waited over a month to report her missing. And still neither the father or her are held accountable.
