Court blocks part of Alabama immigration enforcement law

A federal appeals court has blocked enforcement of parts of a controversial immigration enforcement law in Alabama.

The injunction issued Friday from the 11th Circuit U.S. Court of Appeals in Atlanta came after the U.S. Justice Department - supported by a coalition of immigrant rights groups - requested the legislation, known as HB 56, be put on hold until the larger constitutional questions can be addressed, a process that could take some months at least.

The Obama administration argues the Constitution does not permit states to deter illegal immigration, saying an issue with foreign policy implications is the exclusive mandate of the federal government.

Alabama's law, passed by the legislature this summer, would allow state and local officials to check the immigration status of public school students; to detain suspected illegal aliens without bond; and make it a crime for immigrants who lack proper documents to conduct business with the state for things like driver's licenses.

Among selected provisions blocked from being enforced are:

- Section 10, requiring immigrants to carry an alien registration card;
- Section 28, allowing public school students to be questioned about their immigration status.

Among selected provisions Alabama will be allowed to enforce are:

- Section 30, blocking undocumented immigrants from entering into a "business transaction";
- Section 12, allowing local law enforcement to stop, detain or arrest upon reasonable suspicion anyone "unlawfully present" in the state

    Border states I would think the Feds are correct. Interior states with no borders shared with foreign countries, STATES RIGHTS should rule. OBAMA just wants more votes, tell him and his cronies to shove it.

    Its not about illegal immigrants; which EVERYONE is fine with as long as they can get a McD hamburger for a buck since that tomato was picked by underpaid immigrants......its about hate toward a group of people with a different culture who do not see the need to sync with mainstream America since most will return to their countries of origin.
    if you listen to the people who push these bills in the different states they sound like the KKK and are mostly white, older men and women who also opposed African-Americans and women's rights.
    Don't sell yourselves and only listen to the hate which makes sense to you on the spur of the moment. Think about it; take a look at some of the economic challenges for farmers and then take a long hard look at the cost of groceries in your local market.....who is picking all that? Who is sewing that shirt you bought at Walmart for $7 bucks that 10 years ago would have cost you $25?
    Do something revolutionary....educate yourself. Think. Your future might just thank you.

    Today, tomorrow, or next week, several states need to pass Arizona/Alabama-style enforcement laws. A show of solidarity must be demonstrated immediately and send a message to the Obama cartel that they, or no administration to follow will be allowed to use criminal invaders as political pawns. Either the states unite to delouse the country of Mexico's exports, or we give up, drop our pants, and bend over. What's it going to be?

    One thing I noticed about the three famlies on the news this morning was that only one spoke English. Why do these people from Mexico insist that we learn their language. I find this offensive. I would like to understand their reasoning for this. Some of these people have been in the USA for over ten years!

      They don't need English to spend 14 hours picking the food from the ground...
      Yes people need to learn English to function in this country, and seriously, that is part of the reasoning for it. Many people do learn Englsh, but the same lack of education and training which allows them to be utilized as brute labor is unreasonable to expect they then suddenly stand up and say hey, my future here is a good one if I learn English. People forget the majority do not have the education and training to even understand they need education...
      it is a failing in the system for them, and for us, but WE do have the education to understand it is what separates us. WE do. And once you know something you can't unknow it. So the question then becomes, are you personally willing to help them? Are you going to be a part of the solution or a part of the problem?

    On the USD it says "In God we Trust" Well if god made this world for everyone why have borders and a thing called VISA and stop people from coming and going. 200 years ago there was no visa. And in 200 years there will not be either. Make a World SS#, Europeans have it why can't AMERICA GET WITH THE PROGRAM???? If America ever dies out, and Mexico is the new USA! Then watch all you guys trying to jump out there also. GIVE Kids USC, and let it go! IF u don't want illegals then go pay $5 for an apple cause an american had to do the job. Let it go people.

    It's going to take a while to get rid of all the illegal aliens in this country but it will be done. About 80% of Americans want them gone now that they've found out how many we have and what it's costing us. More and more states are passing laws against illegal immigration. Sorry, Micheel, but getting rid of the costs of illegals will more than pay the few more cents a pound of tomatoes will cost. If the illegal aliens want to live in this country, they will have to leave and get in line. The US brings in one million new immigrants, legally, every year – more than any other country in the world. That doesn't sound racist to me.

      Hell yes....get rid of all those dirty Mexicans. And with them all the labor intensive crops and the American farmers as well. So we import all of our food. And with no one working the slaughter houses, I guess we import all of our meat too. And that's the easy part. Who is gonna cut your grass....trim your trees? HA...who? You?

      Portland must be really struggling with only a 7% Hispanic population (78% white). Gee, life is really hard knowing that ONLY illegal aliens cut grass, trim trees, a kill cows when you can only muster a lousy two or three percent. What border states need to do is sponsor bus loads of illegals to travel to Portland; we can spare 100 or 200 thousand and will never miss them. However, if we send Portland this gift, they must promise never to legalize them, cause that would put the city right back at square one.

    Well said Justie. Health care alone is staggering. I spent a lot of time in a hospital when my daughter was ill. I saw the amount of people that came there. I have known many legal immigrants. Why should some be given free status when there are those that work for it. That is what is not right.

    Mexico has serious issues, its why people try so hard to jump the border anyway to come here. If we weren't in such bad shape ourselves as a nation, it wouldn't be so bad. This country has issues too! We have an obligation FIRST and FOREMOST to the AMERICAN people! We have to make sure our own house is in order before we can help someone else. Too many people want to make this a racial issue, those people can jump off a cliff! We need an Administration that honors what it says its going to do, and not just talk a bunch of JIVE. Talk without action is a waste of good oxygen. Do what's right for the American people, not what will fill your pockets or get you a better approval rating! Do that and America will love you for it and you will get what you want anyway. What we need is another 'Reagan' someone who cares about this country and puts the AMERICAN PEOPLE FIRST.

      President Reagan signed the Simpson-Mazzoli act in 1986...giving amnesty to some 1.3 million illegals...plus consideration for some skilled farm workers to legally be in the US. Although it wasn't all cake and ice cream for every one, it was a smart move at the time.

    Although I am sympathetic to the plight of Mexico, and the reason some desire getting to America any way they can, it's time to call it what it really is: ILLEGAL!!!!!!
    And all illegal aliens are not Mexican, but all illegal aliens are ILLEGAL!
    What part of ILLEGAL don't you comprehend?
    Build a wall. Ship them out.

    You come into my neighborhood, somebody hires you because their cheap sob's. You proceed to pitch a tent in MY yard, and then walk up to my door and demand that I feed you, educate you, clothe you, get you medical care, and to top it off, you pop a squat on my lawn and squirt out a kid, which you want me to pay for. THEN your kid is called a member of my household because you had your kid on my lawn! When I complain that I can't afford this, you get p!ssed and call me a bigot. YOU CAME HERE ILLEGALLY!!!

    I know this is a simplistic explanation, but I really don't care what ethnicity pitched a tent on my front lawn, but if you're illegal, I shouldn't be under any obligation to take care of you. And neither should my country.
