U.N. official critical of Manning detention

U.S. Army Pfc. Bradley Manning, accused of aiding the enemy by passing reams of classified military documents to WikiLeaks, may have been treated inhumanely by the U.S. military since his arrest in 2010, according to a report from the United Nations' top official on torture.

The findings are the result of a 14-month long probe conducted by U.N. special rapporteur Juan Mendez and released late last month. They could spark a debate about Manning's case as it winds toward a court-martial later this year. The latest hearing in Manning's case is scheduled for later this week, at which motions made when Manning was charged on February 23 will be heard.

In his February 29 report, Mendez wrote that he appealed to the United States to get an unmonitored interview with Manning but was unsuccessful. He told the British newspaper The Guardian that he cannot give a definitive report on Manning's treatment because he cannot visit with the soldier alone.

The soldier has been held in military detention since his arrest in May 2010. He was then an Army intelligence analyst at Forward Operating Base Hammer outside Baghdad where, prosecutors say, he put software on secure computers that allowed him to download classified material and burn it to a compact disc.

Manning is facing 22 charges, including aiding the enemy, which could send him to prison for life.

Mendez wrote that Manning was kept alone in a cell for 23 hours a day for nearly one year at the Marine Corps base at Quantico, Virginia, where he was kept before his transfer to Fort Leavenworth, Kansas, in April 2011. The solitary confinement ended when Manning was transferred to Leavenworth, Mendez wrote.

"The Special Rapporteur concludes that imposing seriously punitive conditions of detention on someone who has not been found guilty of any crime is a violation of his right to physical and psychological integrity as well as of his presumption of innocence," the report said.

Mendez stressed that "solitary confinement is a harsh measure which may cause serious psychological and physiological adverse effects on individuals regardless of their specific conditions." Depending on the circumstances of Manning's case, the decision to hold Manning in this manner might have breached an international convention against torture.

Manning's attorney David Coombs has long decried on his blog that Manning was treated inhumanely at Quantico. Coombs has also used his blog to hint at how he might defend his client.

    So much stupidity here! First: hanging and firing squad is out! It is now lethal injection. Second: This "soldier" has totally failed in his duties and the oath he took and should suffer the consequences. Personally, I would rule out any death penalty, but life, without parole is OK!

    If we reinstated the Selective Service we could actually cultivate the best military in the world as only the best and brightest would make the cut. As it is now they need just about anyone that enlists.

      Humberto it's called the draft, you are familiar with this term right? No matter how many machines or smart bombs we have we will still need soldiers, the selective service can weed out the weak minded, weak moral standard, borderline psychos, etc.

    So Special rapporteur Juan Mendez of the UNited Nations is telling the US how we shoudl treat our Military Prisoners?

    I suppose the UN appointted Mendez, who represents Argentina, since he has witnessed his country's own crimes against humanity and would probably be considered an expert in point the finger somehwere else.

    Get over it.... This kid is in the US Army... He had a duty, which he failed to carry out by releasing classified information... Now he wil be tried, and if convicted, punished. This isn't rocket science... it is a soldier who thought he was smarter than his superiors and is now trying to stir public opinion to avoid serving time in jail...

    How about we stop talking about him and let justice take its course

    I doubt he's being treated any differently than any other soldier there, but maybe this treatment needs to be reviewed after the human rights abuses exposed at Gitmo and other military detention facilities. Are soldiers under court martial being treated like soldiers up until they're found guilty, or are they being degraded like terrorists?

    Let's review. An alleged reporter states he was never able to interview Bradley during a 14-months long probe. Hmmph. Some probe. Unable to actually interview his target, this knucklehead then goes ahead with what must be years of psychological training under his belt, no doubt with degrees in the subject, and working experience in the field, to make some half-rear end deductions, that Bradley's attorney apparently latched onto immediately. Why was this alleged story even published? Pathetic by all involved.

    this soldier betrayed his country. He took the oath to defend the usa. I think he disgraced ever veteran that ever fought and died for this great nation. Ppl dont realize the info this soldier released puts usa soldiers life in danger even more than what they already are. The enemy retaliates when they see these videos. Ppl war is ugly bad things do happen and so do mistakes we the usa is not perfect. We americans need to stick together and not fight. What this soldier did was wrong and he needs to be held accountable for his actions. As a us soldier u learn loyalty and live by that.
