Special prosecutor will not use grand jury in Trayvon Martin investigation

[Updated at 12:11 p.m. ET] State Attorney Angela Corey, appointed as a special prosecutor in the February shooting death of 17-year-old Trayvon Martin, has decided against sending the case to a grand jury, her office said Monday.

"The decision should not be considered a factor in the final determination of the case," Corey's office said in a statement.

The grand jury, set to convene on Tuesday, was previously scheduled by the former prosecutor.

Corey previously said she has not used grand jury's in cases like this and added that from the time she was appointed she said she may not need a grand jury.

The decision about whether or not to charge George Zimmerman in the case now rests with prosecutors.

"At this time, the investigation continues and there will be no further comment from this office," in the statement.

The decision means that the timetable for any possible charges remains up in the air.

"We had hoped she had enough evidence without the need to convene a grand jury,” Ben Crump, the attorney for the Martin family said about Corey. “The family is trying to have patience and faith through all of this."

Crump said they are hoping for charges and an arrest as soon as possible.

"We know we want that day to come,” Crump said. “We want a very public trial so the evidence can come out and show people that the justice system works for everybody."

Crump added that he believed the evidence that has come out has “made it clear” that charges should be filed, without the need of a grand jury.

George Zimmerman's new attorney, Hal Uhrig, told CNN that he was "not surprised" by the announcement.

Uhrig said he doesn't know what her ultimate decision will be but that the move to go without a grand jury is a "courageous move on her part."

Martin ventured out from his father's fiancee's home in Sanford to get a snack at a nearby convenience store. As he walked home with a bag of Skittles and an Arizona iced tea, he was shot and killed by Zimmerman.

Sanford police questioned Zimmerman and released him without charges.

From there, the case has evolved into opposing allegations from Zimmerman's supporters, Martin's family and authorities.

Zimmerman says he killed Martin in self-defense after the teen punched him and slammed his head on the sidewalk, according to an Orlando Sentinel report that was later confirmed by Sanford police.

The case  has triggered a nationwide debate about Florida's "stand your ground" law - which allows people to use deadly force anywhere they feel a reasonable threat of death or serious injury - and race in America.

This makes it sound like he was just walking down the street when Zimmerman just walked up and shot him. While we may not know all the details, we know that more was involved than that.

      It sounds simple because it is simple. Martin was walking to the home he was staying in when Zimmerman hunted him down and shot him. Even if Martin fought back, and I hope he did, Zimmerman cannot use stand your ground as a defense when he was the pursuer. You've lost site of the fact that an innocent teenager was killed for simply walking through Zimmerman's neighborhood.

      All that we need to know is enough to have probable cause for an arrest. Trayvon was in a neighborhood where he had business.He had an ice tea and Skittles. It was raining, he had on a hoodie. He was on the phone at least part of the time during the encounter making it unlikely that he was up to no good. Zimmerman did not have injuries consistent with that of a person's whose head was banged against the concrete. Furthermnore, there was no blood on his clothes from a reportedly broken nose. Anyone with elementary reasoning skills can conclude that there was probable cause for Zimmerman's arrest.

Just think about your own kids for just 1 minute....There are so many predators out there. What do we tell our kids? What do you say to them? –Be careful. If somebody starts following you in a car – RUN! If you think someone is following you-RUN! It doesnt matter if you are black, white, latino, asian, or mixed up melting pot. If you saw somebody slowly following your 16 yr old daughter in a truck what do you tell her to do? If someone was walking behind your 14yr old son and he sees them around 1 corner, then he runs away, and the dude shows up around the other corner- do you think your kid would be scared? WOULD YOU BE???!!! If some stranger walks up to your kid and asks in a demanding manner Who are you?! is your child required to answer that stranger? Do you tell your kids to talk to strangers who walk up to them? If your 17 year old kid gets asked by somebody in a truck while walking in YOUR OWN NEIGHBORHOOD – Hey! Where do you live?? are you saying you want your 17 yr old to answer them like he's their daddy? Not a cop, not a security person- just some dude who walks up to them... If someone pushes your kid or acts like they may assault them do you tell them to lie still for the person? I just want to ask those questions. Don't need to ask if your kid is black. I dont want to know if your kid is asian. Dont even need to ask if he's tall or short. WHAT DO YOU TELL YOUR CHILD AGE 15-19 TO DO IF THEY ARE APPROACHED BY A FREAKING STRANGER WHO IS ASKING THEM PERSONAL INFORMATION???

    I'm sick. I can't sleep well. Answer my questions and tell me that you tell your kid holding a bag of skittles to talk politely to a stranger who follows them around, not in any kind of uniform mind you, to answer the stranger's questions.

      Well, you DON'T tell your thug children to go back and ATTACK the person they are supposedly so afraid of. Listen to the 911 call – Martin was arranging to meet the Police. He was on the PHONE for quite a bit of time. If Martin had continued on to his dad's fiancee's place, HE WOULD HAVE GOTTEN THERE – IT WAS NOT THAT FAR. This just supports Zimmerman's story that MARTIN CAME BACK AND WHACKED HIM. The thug wannabe didn't like the little hispanic guy following him and reporting him to the police.

      He did not stalk the kid – LISTEN TO THE 911 CALL or read the transcript. Zimmerman was making arrangements to meet police that would be coming – he no longer was following Martin. Zimmerman was also on the phone for an extended period of time, more than enough time for Martin to leave the area and go "home". This leads credence to Zimmerman's accusation that Martin can back and STRUCK HIM.

      Again, Zimmerman was following the kid WHILE HE WAS ON THE PHONE WITH 911. He was told that he did not HAVE to follow Martin, and stops soon afterwards and began making arrangements to meet the police at the community mailboxes. That does not sound like "FOLLOWING" or "STALKING". The little thug thought he was tough and went back to attack Zimmerman, or at least that is what it looks like if you listen to the RECORDED evidence.

      Though I would like to see justice prevail during my lifetime, I know it will prevail in the end. Whether or not Zimmerman pays for his deeds now (and whether the state of Florida pursues justice or not), he will eventually pay for his deed (without question). Don't worry about it “colliersf”; you will personally be rewarded for your deeds too – your comments on this website. Whether you believe in a higher power or not is irrelevant. “HE” – the higher power – doesn't actually need people to believe in him for him to his business . . . has something to do with him being an (the) actual true and very much living “G-o-d”. We only help ourselves out through belief – HE is who HE is – . . . He doesn't really need us. No other post from you is even necessary; the less you say, the better . . . but if you so choose, “do you”. HE heard you (and hears you) and will reward you accordingly. You can count it, and whether or not you ever tell a living soul, you and I both will know, HE is rewarding you for your work :-). You can repent for it now (and find HIS Grace is sufficient to help you), or you can do it later (when it’s too late).       @nicki – it is too bad that you are sad, but MAYBE the "black community" should stop teaching their kids to go back and attack someone that is reporting them to 911. If you bother to listen to or read the 911 transcript, you will see that Zimmerman was not following Martin – the only way for the confrontation was for Martin to go back and attack Zimmerman. It appears that Martin made a bad decision in trying to "teach Zimmerman a lesson" for disrespecting him.

    That's the problem- all the statements of "fact" that aren't true. He did NOT follow Martin after being told not to do so. He returned to his vehicle according to the 911 dispatcher and the statements given to police. Everybody ought to shut their mouth instead of spewing the version of the incident they WANT to believe and let the Special Prosecutor DO HER JOB!! We have laws in this country – not mobs. Let the laws work. By the way- "stand your ground" is a straw man in this case- it did not apply. There is nowhere in America that a person may not be justified in the use of deadly force if they reasonably believe that they are about to be killed or about to be devastatingly injured. In most jurisdictions, however, they may still be charged, and will have to rely on the affirmative defense of "self-defense" in court. Its time to call things by their correct descriptions and stop spinning this case to accomplish the spinner's objectives. How about a little justice under the law?

      II digress. Stand your ground absolutely applies. And this is far from a straw man argument.

      (3) A person who is not engaged in an unlawful activity and who is attacked in any other place where he or she has a right to be has no duty to retreat and has the right to stand his or her ground and meet force with force, including deadly force if he or she reasonably believes it is necessary to do so to prevent death or great bodily harm to himself or herself or another or to prevent the commission of a forcible felony.

      This is why they have nothing to charge him with. There are 7 States in the Union that have weak or no specific castle law. 28 States have Castle, the rest stand your ground.

      @1safechick – or the Police actually listened to the 911 call or read the transcript and saw that Zimmerman was heading back to his vehicle. They also realized that Martin had PLENTY of time to go "home" during the period when Zimmerman was ARRANGING TO MEET THE POLICE and the ONLY way they would have had a conflict was if Martin came back to attack / confront Zimmerman, which is what Zimmerman stated. There is also a witness THAT ACTUALLY SAW THEM BOTH ALIVE AND MARTIN ON TOP PUMMELING ZIMMERMAN. That is right, not some witness who "heard" something and FELT the voice belonged to the "young man" (as displayed on TV with all the old pictures).

      If Race is not an issue please tell me why it's either African Americans or Whites giving thier opinion or being polled. NOT ONE LATINO OR A LATINO POLL IS TAKEN. How many Latino's you know named Zimmerman. Mitt Romney is more Latino than George Zimmerman because Mitt's father is Mexican. It's a black and White issue so stop trying to hide and ignore that this country has a problem. No need for statistics on black crime because we can go all the way back to slavery with Statistics.     Not surprising choice. There is no way the Attorney general of Florida is going to let "lay people" make a judgement on the "stand your ground" law. It is her job to protect it at all cost. My opiniion is that the NRA is telling her to make sure and issue the judgement that it was just pure and simple "self defense" and lucky or Zimmerman he was carrying a gun and was able to protect his own life.... well thats what they want us all to believe.
